아동방임·학대의 실태와 대책에 관한 연구 = (A) study on status and solutions of child abuse and neglect

다국어 초록 (Multilingual Abstract)

Child abuse has existed in Korean society for many generations. It is prevalent in all societies but it has no correlation with the factors such as socioeconomic classes, educational standards. Thus, the effects of child abuse present significant social problems everywhere.
Especially in Korea, much emphasis has been put on physical discipline as a means of educating children. There are several cultueal reasons for the widespread use and acceptance of child abuse. First, Korean society is modeled after patriarchal society. Secondly, parents believe discipline is an important tool to instill a value of respect for their elders. Thirdly, most parents in Korean society believe they have the right to discipline their children even though they may be violating the tight of their children.
So, it is this background where child abuse has been hidden, for parents do not regard their children as self-sufficient individuals. Eventhough under the constitution and the children's charter, all children are granted the rights of happiness and dignity, the attitude of proteccting children from abuse seems uncommon due to the lack of attention given to this problem.
Despite of the common occurrences of child abuse, the majority of the unnoticed by the authorities. This is due to the inability of the authorities to punish those who commit these crimes, and the difficulty in separating children from their parents in abusive circumstances. Thus, the reality exists that child abuse is difficult to expose and prosecute, which makes a solution for this social problem much harder to find. We must make an honest effort to utilize the Korean legal system to solve this problem. there is no consensus as to the definition of child abuse and neglect. Many scholars have differing views on the subject which makes finding the root of problem much more difficult. To find the solutions to the widespread effects of child abuse and neglect, one needs to consider the following factors. First, we need to set a definition and range as to what, one considers, child abuse to be. Secondly, we need to recognize the need for new approach in thinking about child abuse and neglect. Finally, we must make laws to prevent and cure occurrences of child abuse and neglect, possibly by implementing laws which require report of abusive cases. The purpose of this study is to increase the awareness of child abuse in Korean society so that people's perspectives may be changed as to the negative effects of this problem.
