치과위생사의 업무 범위에 관한 법 제도 개선 방안

국문 초록 (Abstract)

현행‘의료기사 등에 관한 법률’시행령은 치과위생사의 현실적인 업무를 반영하지 못하고 있는 실정이며, 현재 석, 박사가 배출되고 있는 상황에서 법률 개정은 반드시 필요하다. 이에 본 연구는 미국, 일본, 영국, 네덜란드의 법 제도 비교 분석을 통해 최근 쟁점이 되고 있는 치과위생사의 업무 범위에 대한 방향을 제시하고, 치과위생사 ‘의료기사 등에 관한 법률’ 개정의 필요성과 개선방안을 제시하고자 한다.
본 연구는 치과위생사의 법제도 개선 및 기존 치과위생사와 관련 선행 연구를 조사하기 위한 문헌 고찰로 각 국가별 비교 연구를 실시하였으며, 자료 수집 절차 및 분석은 1단계 주요 검색어를 대상으로 문헌을 검색을 하였고, 선별된 논문의 초록 및 원문을 바탕으로 해당 연구에 필요한 본문 60개를 선정하였으며, 기타 정보는 해당 국가 법령사이트 및 협회 사이트를 통해 자료를 취합하였다.
한국, 미국, 일본, 영국, 네덜란드 총 5개국 치과위생사의 업무 범위와 제도를 비교 분석한 결과 미국, 영국, 네덜란드는 단독법 및 치과 관련법을 제정하여 업무 범위에 따라 치과의사 지도 아래 및 단독업무를 수행하고 있었고, 미국은 주별로 차이가 있었다. 일본은 단독법이 제정되어 있으며, 치과의사의 지도 아래 업무를 수행하여, 예방업무에 한해서는 일반지도를 허용하고 있는 반면, 우리나라의 치과위생사 업무 권한 및 범위는 지나치게 제한적이며, 치과위생사의 학문적 발전에 비해 전문적인 업무 수행과 법적 보호를 받지 못하고 있는 실정이다.
따라서 우리나라 치과위생사의 업무 범위와 법 제도 개선 방안을 다음과 같이 제시하고자 한다.
첫째, 치과위생사 법적 업무 범위 정립과, 업무 위험도에 따른 간접지도와 직접지도를 구분하여 전문성과 독자성이 발휘될 수 있도록 법률을 개정할 필요가 있다.
둘째, 8개의 직종을 동일 기준법으로 적용하고 있는‘의료기사 등에 관한 법률’은 현실적으로 맞지 않으며, 의료환경 변화에 대응하고, 각 직종 간의 전문성 확보를 위해 치과위생사 단독법 제정이 필요하다.

The Medical Technicians, etc. ACT does not reflect the practical work of dental hygienists. Thus, this law needs to be revised for the current situation, where the number of master’s degree courses and doctorate courses are being produced.
This study is intended to present the direction for the scope of work for dental hygienists, which has recently been a controversial issue, through a comparative analysis of the legal systems in the United States, Japan, Britain, and the Netherlands. These improvement measures aim to revise the Dental Hygiene Act.
In this study, a comparative analysis of the legal systems related to dental hygienists in each of the above mentioned countries was conducted as a literature review to investigate the existing works and improvements. The data collection process and the analyses were conducted in the first phase of the literature search. Sixty texts were selected for the study based on the green and original texts, and other information was collected from the relevant national statute sites and companies.
According to a comparative analysis of the scope of work and system regarding dental hygienists in five countries, namely Korea, the United States, Japan, the United Kingdom, and the Netherlands, the following information was found.
The United States, the United Kingdom, and the Netherlands exercise direct access and supervision according to their scope of work by enacting separate dentistry related laws. However, the laws of the United States differ from state to state. Japan has separate laws for general supervision only for preventive work by performing direct supervision. The authority and scope of work of dental hygienists in Korea are excessively limited. They do not receive professional work performance and legal protection, as compared to the academic development of dental hygienists.
Therefore, the scope of work for dental hygienists in Korea and the measures to improve the legal system are presented as follows.
First, it is necessary to revise the laws to establish the legal scope of dental hygienists and distinguish between general supervision and direct supervision based on work risk to ensure that professionalism and identity can be exercised.
Second, The Medical Technicians, etc. ACT is not suitable for applying eight jobs to the same standard, and the Dental Hygiene Act is essential to cope with the changes in the medical environment and secure professionalism among different professions.
