The European Union makes every effort to ensure the free movement of person and goods inside the community. But, international transactions inevitably bring about cross-border disputes. Because of the sovereignty of individual members and independent legal systems, the civil and commercial disputes that might occur among Member States citizen is characterized as part of an international conflict.
The international civil dispute is part of conflict of law. Unfortunately, the solution through international lawsuits does not give relevant satisfaction because of delayed procedures and higher costs in terms of speed and economy that is based on ideology of procedural law.
Thus far, the dispute characterized as international conflict has been resolved not only by a treaty between sovereign nations, but by international private law between the nations.
Because the European Union has its inherent legislative powers in the community, the disputes characteristic of international conflict came to be resolved in the forms of rules and guidelines that may be part of legislative procedures.
In other words, to resolve the dispute characteristic of international conflict, the European Union has applied international treaty before the EU's establishment, but has enacted uniform laws in the forms of rules and guidelines that are based on legislative procedures after the EU's establishment.
Against the backdrops of the EU's continuing efforts, the European Union tried to settle international civil and commercial disputes through Brussel I regulations that may be corresponding to South Korea's international private law. But the prolonged litigations characterized by international lawsuits did not overcome the fundamental problems of the higher settlement costs.
The EU became interested in these problems, and subsequently the new settlement form of the Alternative Dispute Resolution was formally materialized at the Tempere Conference in Southwest Finland on October 15, 16, 1999. Thereafter, The European Union came to enact the 2008/52/EC Directive on May 24, 2008 through ten years' researches.
The EU began to recognize the ADR as one of its access to justice approach. For example, please refer to the European Convention on Human Rights article 6, The Charter of Fundamental Rights of EU article 47, Treaty on the Functioning of the European Union Chapter 3(judicial cooperation in civil matters).
The access rights to private justice can be regarded as an access to regional courts and more wider access to national courts and is ADR organizations. The European Union has chosen the legislative type of Directive in the judicial cooperation and presented the minimum criteria for the ADR. Individual members have been provided its discretion to enact laws of its own choice depending on the circumstances. Most of the European Union Member States have legislated implementation laws conforming to the principles of the ADR.
The minimum criteria comprises the confidentiality, enforcement of mediation agreements, impact on statutes of limitation and incentive or Sanctions is on the basis of at least. Recognizing the roles of mediator, each Member States are working together to ensure the quality of mediation.
However, the applications of the ADR in the judicial process stand for only 0.5%∼2 percent in the European Union Member States. In this connection, the EU seeks effective methods to make use of the mediation through either legislative or non-legislative solutions. For example, there are strong confidentiality protection, financial incentives, lawyer duty to inform clients, and robust mediator accreditation systems.
EU mediation directive not only applies to domestic affairs in Europe Union member states but also to international law disputes. Judicial cooperation can be realized through these efforts. This example shows that the ADR methods may be a meaningful means to resolve disputes in the process of strengthening economic and judicial cooperation with foreign nations.
Finally, The European Union made every efforts not to undermine the basic philosophy of the mediation in the process of enactment and implementation. Our major attention should be given to the matter of the EU's experiences in making basic framework of korea mediation system.

(Directive 2008/52/EC of the European Parliament and the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters)을 제정하기에 이르렀다.
유럽연합은 유럽인권조약(the European Convention on Human Rights) 제6조, 유럽기본권 헌장(The Charter of Fundamental Rights of EU)
(Impact on statutes of limitation), 장려책과 제재사항(Incentive or Sanctions)등 조정제도의 핵심쟁점들을 다루고 있다.
