대한민국 헌법에서 규정하고 있는 대통령의 권한은 다른 국가와 비교해도 그 권한이 강력하고 막강하다. 대통령의 여러 권한 중에서도 전제군주의 은사권에서 유래된 사면권은 법을 초월하는 군주의 권위를 상징하는 것이었다. 어떠한 사법적 절차에 따라 어떤 처벌이 예정되어 있거나 또는 집행 중에 있더라도 군주는 이를 무효화할 수 있는 권한을 보유하고 있었던 것이다. 이러한 전근대적 사면권이 현대의 법치국가에서도 여전히 인정되고 있는 이유는 아무리 법치국가적 절차를 완벽 하게 갖추어 있다고 하더라도 오판의 가능성, 법이념 이외의 가치에 대한 고려, 악법의 존재, 형사정책적 고려 등의 필요성에 의해 유지되고 있다. 헌법 제79조 제1항도 “대통령은 법률이 정하는 바에 의하여 사면·감형 또는 복권을 명할 수 있다”고 하여 대통령의 사면권 등에 관하여 규정하고, 같은 조 제2항 및 제3항에서는 일반사면과 사면 등에 관한 법률의 헌법적 근거를 명시하고 있다.
사면은 좁게는 형선고 효과의 전부 또는 일부를 소멸시키거나, 형의 선고를 받지 않은 자에 대하여 공소권을 소멸시키는 국가원수의 행위만을 일컫지만, 일반사면, 특별사면, 감형과 복권을 모두 포함하는 넓은 의미로 사용하기도 한다.
그동안 역대 정권은 정권의 필요에 따라 무분별·무원칙적인 사면을 빈번하게 대대적으로 시행하였다. 수백만 명에 이르는 대규모의 사면은 그 실질은 일반사면이지만 특별사면의 형식을 취하고 있다. 이는 국회의 동의를 거치지 않고 행사될 수 있는 수월성에 기인한 것인데, 일반사면을 해야 할 사안에 대하여 자의로 특별사면으로 처리한다면 국회의 권한을 무시하는 결과를 초래한다는 논란이 거세게 제기되고 있다. 특히 정부수립이후 단행된 역대 정권의 특별사면은 주로 권력형 비리와 부정부패를 저지른 자들에 대한 구제조치로서 남용되어 왔음을 알 수 있다.
이는 현행 사면법이 사면 대상과 기준 등 사면권을 견제하고 제한하는 합리적이고 실질적인 내용을 규정하지 않은 채 단순히 사면에 관한 내용과 절차를 규정하는 데 그치고 있기 때문이다. 이 같은 현행 사면법의 현실적인 법적 문제는 사면권의 남용을 방지하기 위한 제도적 장치의 미비로 적절한 통제가 이루어지지 못하여 왔다. 그 결과 대통령의 사면권은 무소불위의 제왕적 권력으로서 법치주의를 훼손한다는 거센 비난과 함께 끊임없이 사면법의 개정논의가 제기되었다.
따라서 사면대상의 광범위함, 정략적 고려에 의한 대상자 선정, 사면권에 대한 법적·제도적 통제 수단의 부존재, 대통령령에 의한 일반사면, 양심수 사면 등의 문제점을 지적하였으며 그 개선 방안으로는 첫째, 대통령의 사면권에 대한 제한과 견제를 실효적으로 하기 위해서도 사면의 사유 등 실체적인 요건 등에 대한 규정을 추가하고, 현재의 제도와 합치하는 법 문언으로 개정하는 등 대책이 마련되어야 할 것이고 탄핵 대상자, 공직 비리 사범, 고위층 범죄자에 대한 사면이 불가능 하도록 법제화하는 방향으로 사면법을 개정해야 한다. 둘째, 절차적 규정의 보완점도 강화하여 사면을 받고자 하는 자의 출원에 의한 심사가 이루어지게 하여 신청단계에서 국민적 공감을 얻기 어려운 비리 사범의 경우 스스로 신청할 엄두를 못 내게 할 필요가 있다. 셋째, 사면심사위원회의 기능과 역할을 더욱 강화하여 9인의 위원수를 더욱 확대할 필요가 있고 대통령이나 법무부 장관에 의해 구속력 있는 의견을 제시하는 지위를 부여 할 수도 있다. 넷째, 대통령 사면권은 사법부의 판단을 변경하는 권한으로써 권력분립 원칙의 예외가 된다. 따라서 사면 시에 대법원 또는 대법원장의 의견을 청취하도록 하는 것도 바람직한 방법이 될 것이다. 다섯째, 사면이 대통령에 의한 사법권의 침해를 가져온 다고 하면 권력분립의 원칙상 사법부가 대통령의 사면권을 견제할 조치도 필요하다고 할 것이고, 비록 일반적으로 대통령의 사면권 행사를 인정하더라도 사면권 행사의 대상으로 제외되는 죄와 형의 조건을 구체화하는 등, 특정한 경우에 해당 피고인에 대한 사면만큼은 이루어질 수 없음을 선언할 권한을 법원이 스스로 보유하게 하는 것도 한 방법이 될 것이다. 사면제도의 존폐와는 관계없이 대통령 사면권의 남용에 대한 법적·제도적 통제를 강화해야 할 것이다.

The purpose of this article is to study the theory and practice of Korean pardon system, to analyse its problems and to suggest some ways of solving or preventing those problems.
The presidential pardon power has originated from an absolute royal prerogative power of the English King. Today, most of the presidential pardons power are in practice to relieve overly harsh judgments or prejudice in the enforcement of criminal law. In addition, it also plays significant role for maintaining the balance of power by checking the judicial branch of the governments.
As of today's democratic society, however, it should be exercised for the public welfare under the contemporary constitutionalism. It is generally agreed upon the needs of the pardon even with the faithful accordance to the rule of law. This could be further justified considering our incomplete legal system combining with the harmonious coexistence of social value and justice as Radbruch pointed out.
Moreover, when social conflicts and tension reached the peak, the pardon can be exercised in order to resolve the situation from a political judgement. For example, crimes that have been committed in the process of unification in Korea, these would be under the consideration of pardon otherwise could lead to another huge turmoil in the society.
Therefore, it is necessary to give pardon power and authority to the president given that the exercise of this privilege would not violating judicial power. At the same time, it should be used only if the exercise of this right is dedicated for the protection of the national interests as well as for the facilitating national integration.
However, our history has shown that many of the Korean Presidents have done a series of arbitrary and excessive abuse of pardon power. To make matters worse, we could easily witnessed that the ex-presidents in Korea exercised frequent and large-scaled pardons at their conveniences without having consistent principles. The root cause of this phenomenon stems from the fact that the current legislative system prescribe the contents and procedures only, without more detailed specification pertaining to rational and substantial requirement for restricting this privilege. Thus, it is urgent to amend associated laws in order to restrict arbitrary usage of pardon power by fortifying substantial and procedural control.
One of the possible alternatives is to strictly define the subjects of pardon and to provide a self-screening process when one files a petition for pardon. In terms of defining the subjects, the law might specify the exception list for the consideration of pardon such as crimes related to violating constitutional law, war, terror, anti-humanity, supremacy-related corruption, and presidential aids. For refining the procedure, we could confer a petition right to convicts so that self-screen process could be put in place.
Another way of procedural refinement is to increase a quorum in Pardon Reviewing Board consists of nine commission members by inviting judges and civilians.
As does in France and Sweden, it is necessary to configure the associated process in such a way that collecting opinion from the Supreme court become a mandatory requirement for authorizing a pardon. In case of a special pardon, its exercise has to be strictly limited because a special pardon was designed for individual cases, not for a deviation of large-scaled general pardons. In terms of prescribing criminal sentence, we also could list a certain types of crime which is not allowed for the consideration of pardon. The Congress can provide a check-and-balance by exercising a motion privilege when a special pardon is about to be exercised by the President.
The presidential pardon power has to be strictly allowed only if the benefits generating from accepting exceptions in constitutionalism and the independence of jurisdiction is greater than the social costs of legal hazard, social justice, public welfare, and etc. Therefore, today's practices on the presidential pardon allowance will not be supported and be trusted by the people when thousands of criminals are relieved with special amnesty granted by the President. It is not the question of maintenance or abolition, but the matter of protecting our constitutionalism by carefully controlling its usages, process, law, and political practices.
