글로벌화는 사회의 모든 영역에서 전 세계적인 상호연결성이 넓어지고 깊어지는 현상으로 전 세계가 하나의 공간이 되고 있음을 의미한다. 글로벌화를 정치, 경제, 문화적 영역으로 나누어 생각해 볼 때 정치, 경제면에서 획일화가 확실하게 나타나는 것과 비교하여 문화면에서는 각 문화의 정체성과 다양성이 보호되어야 한다는 논리가 힘을 얻고 있다. Crane의 주장에 의하면, 글로벌시대 문화는 다방향으로 상호교류하며 영향을 주고받는 다차원적인 과정이다. 이는 문화들을 서로 비교가능하고 상호교류 가능한 존재로 인식하는 것으로 각각의 문화가 나름의 독특한 정체성을 가지고 있음을 전제로 한다. 따라서 문화적 정체성을 누릴 수 있는 권리인 문화권에 대한 인정이 문화다양성 논의의 기본이 된다. 문화권은 인권의 한 종류로 볼 수 있는데 최근에는 인간이 누구나 누려야 할 기본 권리로서 그 실행이 사회적으로 보장되고 제도적으로 뒷받침되어야 한다는 의미로 발전하였다. 이는 곧 사회적으로 보장을 받기 힘든 소수문화의 권리 보호로서 ‘사회정의’와 연결되어, 문화다양성이 얼마나 많은 수의 문화를 인정하느냐가 아니라 사회적 약자의 문화적 권리를 얼마만큼 보장하고 있느냐에 대한 논의가 초점이 되어야 함을 의미한다.
본 연구에서는 문화다양성 협약의 분석을 위해 다양성의 다섯 가지 차원을 역사적 배경에 따라 재구성하고 글로벌 시대 이후에 강조되어 나타난 상호의존, 평등, 사회적 소수자 보장 측면의 다양성을 그 논의의 성격과 사회에서 받아들이는 태도로 구분하였다. 상호의존의 의미는 이상적으로 사회에서도 긍정적으로 받아들여지는 반면, 평등과 소수자 보장은 서로 논쟁적이다. 유네스코 문화다양성 협약의 여덟 가지 구성 원칙에 이 다양성 요소를 적용시켜 본 결과 상호의존적 의미의 이상적 요소가 강하게 드러나고 소수자 보장보다 평등의 의미가 일반적이어서 협약이 소수자의 문화권을 보호하기 위한 실천적 규범이기 보다 이상적 성격이 강하다는 점을 확인할 수 있었다. 문화다양성 협약의 구체적 조항에는 사회적 약자로서의 소수자를 보호하기 위한 부분이 포함되어 있는데 전문 4, 5, 10항과 본문 2조, 5조, 6조와 7조가 소수자와 토착민 문화, 여성 등을 포함한 사회적 약자의 문화적 권리 보호를 위한 내용을 제시한다. 국가들 사이에서 상대적으로 약자인 개발도상국에 대한 논의를 다룬 14-16조는 개발도상국의 문화산업 강화를 위한 방법과 재정 지원 등을 제안하는데 이 내용은 문화를 동등하게 보는 것이 아니라 선진국이 일방적으로 개발도상국을 돕는다는 뜻이 반영되었다 하여 비판을 받기도 한다.
문화다양성 협약이 사회적 소수를 위한 실제적 규범이 부족하다고 하더라도 문화에 관해 법적 구속력이 있는 거의 유일한 협약이며 문화상품이나 서비스에 대한 소극적 접근이 아니라 문화다양성의 필요를 인정하고 보호와 증진을 목적으로 한다는 점에서 여전히 그 가능성은 크다. 개념 자체의 모호성과 다양한 각 나라의 상황 때문에 이의 해석과 적용에 관한 논쟁이 있지만 이런 적용환경의 다양성이 오히려 활용 가능성을 넓혀줄 수도 있다.
우리나라는 2010년에 문화다양성 협약에 가입하였고 이제 그 가입 필요성에 대한 논의보다는 이를 어떻게 적용할 것인가에 대한 논의로 초점이 옮겨져야 할 때이다. 각 국가별로 나타나는 다양한 상황을 고려하여 사회적 소수자를 위한 문화다양성의 적용이 어떻게 이루어졌는지에 대한 사례를 찾아보고 우리나라의 사회 구성의 특성을 이와 비교하여 파악하는 것은 앞으로 우리나라의 정책 방향을 결정하는 데 도움을 줄 것이다.

Globalization means the whole world becomes one, as the phenomenon where all the parts of society can connect widely and deeply together. Globalization can be divided with politics, economics, and culture parts. Whereas, politics and economic areas certainly show unification, culture part values each culture's identity and diversity have to be protected. By Crane, culture of globalization age is the multidimensional process that has multidirectional cross-fertilization. It means that cultures are appreciated as the thing that can be compared and exchanged, so it is premised that all of them have their own identity. So, acknowledgment of cultural right that can have cultural identity is the basic concept of debate in cultural diversity. Cultural right is a kind of human rights, and recently, the meaning has been developed as the basic right of all the people and the practice need to be protected in social dimension. It is related with ‘social justice’ as the protection of minority culture. Therefore, the discussion of cultural diversity is focused not on how many cultures can be exist but how protected the minority's rights are in the society.
In this research, in terms of analyzing the <Convention on the protection and promotion of the diversity of cultural expressions> by UNESCO, the five levels of diversity have been rearranged using historical background. Especially the three levels, interdependency, equality, practice were emphasized after globalizing, and can be distinguished with attitude to be accepted by the people. Whereas positive understanding of others is interdependent, the equality and practice are argumentative. Substituting this diversity levels to the 8 organization principle of UNESCO's cultural diversity treaty, the positive and idealistic diversity, interdependency has insisted. So the following conclusion, that this treaty is idealistic, is possible. The treaty contains concrete articles for protecting minority as second-class citizens. Preamble 4, 5, 10 and articles 2, 5, 6 and 7 present the contents for the special circumstances and needs of women as well as various social groups, including persons belonging to minorities and indigenous peoples. Article 14-16 propose the strengthening of cultural industries in developing countries, but sometimes these are criticized because they regard the superior developed cultures to help the developing countries' culture unilaterally.
Even though the UNESCO cultural diversity treaty has little practical normative law for minority, it is almost the only treaty that carry legal binding force about culture. also it has great possibility because it is not the passive approach for cultural product or service but, rather the goal for cultural diversity is the protection and enhancement of itself. Due to the ambiguous feature and various situation of each nation, there are many different views about the cultural diversity's interpretation and application. This feature can make the using possibility widely.
Korean society became a part of the ratification of the UNESCO's cultural diversity treaty last year, and now we need to discuss the use of cultural diversity in our society instead of the necessity of ratification. Finding some cases for minorities considered with unique situation of every country have many suggestions. These cases can show us the use of cultural diversity depending on each countries' situation. Considering these cases, when applying cultural diversity, Korean society has to confine the range of the minority as week people and propose the direction of polity for protecting their cultural rights.
