The Special Use Permit system which was introduced recently, is an exceptional approval system for private park developers to develop unexecuted urban park sites into urban parks with the implementation of profit-generating businesses within the boundary of preserving the original function of the park under the agreement with local authorities, and this thesis aims to study the application.
Above all, according to the result of the analysis of the exceptional development permission of Japan which is similar to our Special Use Permit system, size of targeted park and size of profit facility is very similar to that of ours but there is no adjustment system about proper scale of profit facility and there is a limit that constructed park site still remains as privately-owned land after the completion of park development. Based on these similarities and differences, these are the implications for us and future task about management of our Special Use Permit system.
First, the Special Use Permit system has to be managed on the premise that there has to be an appropriate division of roles between public and private sector. Promoting the active participation of the park developers in the private sector in consideration of the financial condition of the local government is needed, however, the park subject to be developed by the private developers needs to be limited to the park appropriate for park development by private sector.
Second, it has to be decided that the area standard of the subject park and the possibility of partial implementation, moreover the criteria for the decision of the scale of profit generating facilities in park as well as the planning criteria for the subject park. Especially, it is urgently needed for us to establish operational guidelines enabling us to secure fairness of the system and the transparency in procedures since the guidelines for the operation od the Special Use Permit system in details is subject to be decided by the ordinance of local government.
These are feasibility study in case of contributed acceptance to park intendance by developing some parts of park site to public housing which aimed urban parks unexecuted in long-term of Suwon City based on the special use permit and making other parts to park.
First, it is judged that realization of business is possible at 300 percents of the floor area ratio in case of flatland neighborhood park which has high appraised value of land and it is judged that realization of business is possible within 10% size of private land at 200 percents of the floor area ratio in case of woodland type and waterside type neighborhood parks which has low appraised value of land in outskirts of city.
Second, through working expenses which combining compensation and money for constructing of park, balance of profit of business can be understood within about 50 percents of total expenditure. Because public contribution ratio by the special use permit can be presumed as about 50 percents of total expenditure, it imply that windfall profits by the special use permit can be collected properly.
Based on the feasibility analysis with representative park, this is simulation analysis result about possibility of realization of project by making size of private land in urban park site, possible floor area ratio and parcel price as variables.
First, when we consider that most of the market price of apartment in region of our country is under 2,500 thousands won per square meter, it is judged that implement of project in region has difficult when appraised value of land of park site exceed 100 thousands won per square meter. It means that application of exception is easy in capital area, metropolitan and large city in region considering the market price of surrounding area.
Second, the floor area ratio of profit facility by special use permit should be under 200 percents, it is advisable to be under 400 percents considering business possibility by high and low of land price of park site. Also, planned development of profit facility is possible regardless of size of urban park when the size becomes over 50,000 square meters, so by deciding the size of targed park for adaption of exception becomes over 50,000 square meters, we suggest improvement of system to follow the prescribed ordinance of local government considering position of park and owned characteristics.
