노인학대의 법률적 의미와 정책에 관한 일 고찰 : 한·미 노인학대 관련법 및 정책 비교를 중심으로

국문 초록 (Abstract)

본 연구의 문제의식은 일관성 없는 기존의 노인학대 개념‚ 노인학대 관련법 및 정책이 지닌 한계에서 출발한다.
이러한 문제의식과 관련하여‚ 불명확하고 일관되지 못한 노인학대 개념을 일차적으로 검토하고‚ 기존의 노인학대 관련법 및 정책을 어떤 형태로 개선할 것인지에 대해 비판적으로 고찰해 보고자 하였다.
이에 본 연구는‚ 우리나라보다 20년가량 앞서 있는 미국의 노인학대 관련법 및 정책을 우리나라와 비교하고 그 시사점을 찾아‚ 한국 실정에 맞는 정책 방향을 모색해 보는데 그 목적이 있다.
기존의 노인학대 연구들은 실태조사라는 양적연구에 치중한데 반해‚ 본 연구는 문헌연구 방식으로 진행되었다. 특히‚ 한국과 미국의 노인학대 관련법 및 노인학대를 바라보는 법조계의 관점을 분석하기 위해 판례를 적용했다는 점에서 타 연구와 차별성을 지닌다.
본 연구를 통해‚ 노인학대 개념의 일관성 및 명확성‚ 노인학대를 객관적으로 판단할 수 있는 공식적 지표마련‚ 연구자 및 관련 전문가 중심이 아닌 노인의 관점에서 형성된 정책의 마련‚ 법적 실효성이 의문시 되는 일부 노인학대 관련조항의 개선‚ 사후문제개입만이 아닌 예방적 차원을 강조한 정책의 발전 등이 요구된다.

The problem of this study starts at the limitations of existing inconsistent concepts of elder abuse, and policies and laws related to elder abuse.
Concerning these problems, I have aimed to review unclear and inconsistent concept of elder abuse in the first place, and then to critically consider how these existing laws and policies on elder abuse are to be improved.
Therefore, the purpose of this study is to find out indication by comparing laws and policies on elder abuse in America which are ahead of ours by about 20 years with those in Korea and to explore ways to establish the policies that are suitable for the circumstances in Korea.
While the existing studies on elder abuse have been focused on quantitative research, that is, fact-finding, this study was progressed by the method of documentary research. Especially, it has distinguished itself from other studies in the respect that it applied precedents in order to analyze the points of views of legal circles on elder abuse and the relevant laws in America and Korea.
With this study, it is required to establish official indicators which enable us to objectively judge the consistency and clarity of the concept of elder abuse and elder abuse itself, to make a policy that is not focused on researchers or relevant professionals but is established from the elders' point of view, to improve some articles related to elder abuse whose legal effectiveness is questionable, and to develop policies that not only provide post-intervention but also emphasize the prevention of such abuses.
