영화산업에서 문화산업전문회사 제도 활성화 방안 연구 = A study on revitalizing culture industry special company system in the Movie

국문 초록 (Abstract)

본 연구는 2006년 4월 28일 문화산업진흥기본법에 의해 법제화된 문화산업전문회사(SPC) 제도를 분석하고, 영화산업에서 어떻게 활용되어지고 있는지, 영화산업 활성화에 필요한 제도인지, 혹은 이 제도를 활성화하기 위해 어떠한 문제점을 해결해야 하는지를 다룬 논문이다.
문화산업전문회사(SPC)란 회사의 자산을 문화산업의 특정사업에 운용하고 그 수익을 투자자, 사원 또는 주주에게 배분하는 회사를 말한다. 영화, 게임, 음반 제작 및 공연 등 문화산업 분야의 특정 프로젝트 수행을 위하여 설립하는 특수목적회사(Special Purpose Company)로서, 프로젝트의 개시와 함께 출범하여 프로젝트 완성과 더불어 해산하고, 그 수익을 투자자, 주주 및 사원에게 배분하는 Project Financing Vehicle(프로젝트 금융 투자회사)를 의미한다.
이러한 문화산업전문회사(SPC) 도입을 통해 국내 영화산업의 문제점인 자금 조달 방법의 한계와 낮은 수익률, 불투명한 투자 시스템을 개선하려고 했다.
2008년 4월 10일 기준 문화체육관광부의 문화산업전문회사(SPC) 등록부를 보면 총 13개의 문화산업전문회사(SPC) 중 목적 사업이 영화인 것은 6개로 가장 많은 비중을 차지하고 있으나, 6개 모두 싸이더스FNH가 설립한 것으로 영화산업에서 활발하게 운용되고 있다고 볼 수 없다.
싸이더스FNH가 문화산업전문회사(SPC) 제도를 활용한 것도 이 제도의 도입효과보다는 창업투자회사의 싸이더스FNH 투자 시 법위반 문제를 해결하기 위함이었다.
문화산업전문회사(SPC)의 도입 효과는 공정성 및 투명성 확보를 통한 투자자 보호와 제작 투자의 인프라 구축, 투자의 촉진, 새로운 투자기법의 도입 유발, 완성보증제도 도입을 촉진한다는 것이다. 이는 국내 영화산업뿐만 아니라 해외공동제작을 활성화하고 해외시장 개척과 해외 자본 유치에 도움을 주게 된다.
영화산업에서 문화산업전문회사(SPC)가 도입 된 지 3년이 경과했지만 아직까지 이 제도에 대한 정확한 평가나 운용 사례에 대한 홍보, 교육도 없었다. 국내 영화 시장의 한계로 인해 국제공동제작 등 글로벌 시장으로 눈을 돌리고 있는 현 시점에서 문화산업전문회사(SPC) 제도 활성화 방안에 대한 연구의 한 걸음을 내딛고자 한다.
