The current hot spring water law is prescribed as 「hot spring water means the hot water erupting from underground with temperature of 25 degrees celsius which its ingredients are not harmful to human body」 (section 2 of the same law) to disregard effective ingredients and therapeutic effect of hot spring water.
Our people have been enjoying hot spring water bath from long time ago and still tend to use it a lot. But individuals or organizations who actually own hot spring water fountains are getting many restrictions in the respect that hot spring water law is an administrative law for control. Doctrines or judicial precedents have also been consistent with an attitude of denying the objectivity of rights on hot spring water, in other words, the private rights on hot spring water.
But among underground minerals, there are ones recognized as the object of mining rights and just like treating these objects as independent real rights by saying that property rights do not extend to such minerals (refer to mining law section 2 and section 3), it seems necessary to recognize hot spring water rights as independent rights in its protection and dealings at a different view from the position of judical precedents.
Accordingly, the rights related to hot spring would have to consider plans to enable registration like in laws related to living trees other than hot spring water management ledger. The plan to make hot spring register can be thought of as a legislative theory.
The problem is what to recognize as the master method toward hot spring. For this, we can think of taking Japan as an example and applying it to our country. Also, we would have to search for a plan to also register hot spring rights by amending real estate registration law to enter and register the details related to hot spring rights from the registration law for the declaration method.
In case of considering the rights on hot spring as real rights of the common law, a definite declaration method must be prepared in order to generate the validity of such alteration. For declaration methods, we can think of recording on hot spring management ledger or registration of category on the register as mineral water site.
This research has been performed by essentially focusing on the objectivity of real rights toward hot spring water rights. Then the reference to actual hot spring law was somewhat neglected. For example, the current hot spring law has many regulations promoting the development of hot springs in general. On the other hand, there are problems such as destruction of ecosystem or drainage and contamination of underground water from excessive development of hot springs because there is lack of considerations on effective and reasonable distribution and usage of underground water resources or the protection of ecosystem and living environment. Therefore, the improvement policies on environmental pollution issues due to such hot spring water would have to be researched.
