A Legal Study on Radio Frequency Usage

As radio frequency is infinite but limited resources, legal controls shall be imposed on its usage. Most countries have their own legal system to control and regulate the usage of radio frequency. In Korea, s the Radio Waves Act("the Act") is the basic regulatory act of this usage, which is based on Radio Regulations("RR") of the International Telecommunication Union("ITU"). To make regulations for the radio frequency usage is very difficult, as radio frequency is in the province of technology.
The purpose of this study is to analyze current legal systems, especially the Act, the Broadcasting Act, the Telecommunications Business Act, and RR, and to suggest alternative measures which are suitable for the technical and politic trend of Korea. In chapter Ⅰ, as an introduction of this study, I raised questions of radio frequency related law, and described the purpose, scope, and method of this study, and then, in chapter Ⅱ, review on the nature of radio frequency, international organizations, and foreign law is incorporated. In chapter Ⅲ and Ⅳ, to answer the questions, I made an analysis of allotment, exploitation system of radio frequency in the Act. In chapter Ⅴ and Ⅵ, I suggested an alternative regime with a conclusion of this study.
In this study, I have made suggestions which can be usedwhen reforming the legal system of radio frequency allotment. To adopt a flexible frequency allocation system is the first one. For that, secondary services and free usage bands may be encouraged like as ISM band. The second one is to renovate the existing frequency allotment system. Compared with any other country's law related with radio frequency, the Act, which was wholly amended by 2000, rules "Frequency allotment" that means granting specific persons the right to utilize specified frequencies. It is similar to radio frequency auction or spectrum license but unique to Korea. It makes a frequency regulation system all the more complicated. With that reason, repeal of frequency allotment should be considered. The third one is to clarify the "Right for Utilization of Frequencies" clear. The subject of right and the standard of transfer or lease of right may be established clear.
Another suggestion is to reform the legal system of radio frequency usage. The first one is to simplify license process of radio station establishment. There are four licence processes in the Act. This turns the process of radio station establishment into a complex one. Licence procedures should be simplified. The second one is to reform the acquisition procedure of satellite orbits and frequencies for telecommunication service provider. The last one is to unify frequency allotment charges and radio wave fees. It is not fair if a single user has to bear the double burden for the same frequency.
Radio frequency is very important resources for Information Technology, but is also limited resources to use. Efficient legal systems that control and rule radio frequency is essential may be needed. In this study, I have suggested more efficient legal systems that would be suitable for present situation in Korea.
