개발부담금제도 운용의 적실성 분석

국문 초록 (Abstract)

본 연구의 목적은 개발이익환수제도에 관한 규정의 고찰과 개발부담금 부과 실증 사례를 조사?분석하여 제도가 갖는 문제점을 도출하고 개선점을 모색하는 것이다. 이러한 연구 가치는 전국 지방자치단체의 표준적인 운영체계 확립에 기여할 수 있다. 연구대상의 공간적 범위는 춘천시의 사례를 중심으로 하였고, 내용적 범위는 개발부담금 부과?징수업무 등 운영체계에서 나타난 여러 현안들을 중심으로 논의하고자 하였다. 개선방안으로는 첫째, 부과대상 적용의 문제점 개선으로 단계별 처리 매뉴얼의 통합관리시스템 구축과 사업범위의 제한규정 폐지를 제시하였다. 둘째, 부담금 산정의 문제점 개선으로 지가산정 팀별 연합으로 특성조사의 실시, 개발비용 산정기관의 신뢰성 강화를 제시하였다. 셋째, 부과시점 및 징수절차의 문제점 개선으로 통합징수제도의 도입, 체납에 따른 조사 권한의 강화, 납부시점과 기간의 개선을 제시하였다. 넷째, 부과권자와 관련된 문제점 개선으로 실무교육과정 등을 통한 전문성의 확보, 소속 감정평가사의 정밀검증 실시, 재산정 성과검수의 방법이 수록된 표준지침의 제정 등을 제시하였다.

다국어 초록 (Multilingual Abstract)

The aim of the study is, with the consideration on the Act on restitution of development gains, to investigate and analyze the cases to draw problems and find a way for improvement. The results may contribute to the establishment of a standardized management system for the local governments. The spatial scope of the research is focusing on the cases of Chuncheon City, and its componential scope is a discussion on the pending issues around the imposition and collection of Development Charge management structure. Four suggestions have made for the improvements. Firstly, for the problem with application of the charge, suggestions have made to build an integrated management system for the level processing manual, and abolish the regulation on the limiting the range of business. Secondly, for the problem with the charge calculations, suggestions have made to implement specific investigations by land price appraising team association, and reinforce reliability of the development cost appraising organization. Thirdly, for the problem with the charging time and collection procedure, suggestions have made to introduce an integrated collection system, strengthen the right to investigate, and reform payment time and duration. Fourthly, for the problem related with the imposing authority, suggestions have made to secure professionalism through job training, implement detailed verification by the affiliated certified public appraiser, and establish a standard guideline with the record of re-assessment of outcome examination method.
