재난 및 안전관리와 관련한 법․제도 개선에 관한 연구

국문 초록 (Abstract)

오늘날 지진ㆍ기후변화 등으로 세계적으로 재난이 급증하고 있으며, 무차별ㆍ지속적인 테러에 의한 인명ㆍ재산 피해가 막대한 실정이다. 이러한 각종재난에 대한 관리는 국가의 국민의 기본권보호의무와 직결되며, 그 중요성은 이루 말할 수 없다. 이에, 본 연구에서는 현행 재난 및 안전관리에 관한 법체계와 제도에 관한 개선방안을 다음과 같이 제시해 보았다. 첫째, 현행 재난 및 안전관리에 관한 법체계와 관련한 기본법으로 볼 수 있는 재난 및 안전관리 기본법, 자연재해대책법, 소방기본법, 민방위기본법 등 개별법률의 불명확한 정의규정을 명확하게 새로이 규정해야 한다. 둘째, 개별법령 상호간의 연계성 부족으로 재난 및 안전관리에 관한 법적용의 모순과 공백이 발생하지 않도록, 면밀한 검토를 통한 법령개정 및 제정이 필요하다. 셋째, 개별영역에 법규정의 지나친 세분화는 당해 법률적용범위에 대한 논란과 관리기관의 중첩, 책임소재의 불분명 등의 문제점을 초래할 수 있기 때문에 포괄적인 국가위기관리 법제화의 필요성이 제기된다. 넷째, 대테러활동에 대해서는 테러를 사전에 적발하고 진압하기 위하여, 국제적인 정보교류와 국내 개별 정보기구로부터 수집한 모든 정보의 통합ㆍ분석을 통하여 대테러활동을 기획ㆍ지휘할 수 있는 통합적 테러대응기구가 필요하며, 별도의 테러방지법제정이 필요하다. 다섯째, 현행 재난 및 안전관리제도에 대해서는 중앙정부가 각종 재난을 관리ㆍ조정할 수 있는 전담조직을 설립할 필요성이 제기되며, 전담조직을 대통령 직속에 둠으로 강력한 종합조정력을 가질 수 있도록 하여야 한다. 다만 대테러활동에 대해서는 대테러활동의 기획과 총체적인 정보망의 구축, 정보의 수집과 공유를 총괄할 수 있는 별도의 대테러기구 구축이 필요하다. 여섯째, 민간부분에서는 총괄재난관리기관에 자원봉사단체의 정보공유ㆍ역할에 관한 안내ㆍ자원봉사자 훈련 프로그램 등을 관장하는 기관을 두는 것이 바람직하다.

다국어 초록 (Multilingual Abstract)

The management on these several kinds of disasters is directly linked to the nation's duty of protecting the people's basic human rights. This study suggested improvement plans for the currently legal systems on the disaster and safety control in such aspect as follows. First, as for the currently legal systems on the disaster and safety control, there is necessity for newly prescribing by clearly defining maximally. Second, the revision of legislation is needed through closely examining its provisions between the existing individual laws and between individual law and regulation order so that contradiction and vacuum cannot occur in applying the law on disaster and safety control due to the lack of connection between mutually individual laws. Given newly enacting legislation, the prudent enactment of legislation is thought to be necessary so that such contradiction and vacuum cannot occur through carefully examining with the existing legislation. Third, the necessity is in agreement in principle for legalizing the comprehensive national crisis management of including disaster and safety control because the excessive segmentation in legislative provision of individual sphere is thought to be undesirable in a sense of causing problems such as controversy over the concerned legislative application scope and ambiguity of responsibility. Fourth, the integrative anti-terrorism organization needed through integrating and analyzing all the information, in order to disclose and suppress terrorism in advance as for anti-terrorism activity, the enactment of the separately terrorism prevention law is considered to be needed that will support this. Fifth, there is necessity for establishing the comprehensive organization that the central government can manage and adjust several kinds of disasters. Sixth, In the private section, our country is also thought to be desirable to put agency of administering the guidance․volunteer training program on information sharing․role of volunteer group in the general disaster management agency.
