폐기물 관련 법령체계의 문제점 및 개선방안 = A Study concerning Legal Framework on Waste Management and Resource Recycling in Korea

다국어 초록 (Multilingual Abstract)

Korean government focused reuse and recycling of resources and undertook major changes on its own national waste management policy since 1990s. Despite such a change in policy, the definition of waste has not been changed since 1986. The Korean statutes on waste management and recycling are so complicated and difficult for laypeople to understand. Such a problem is due to unprincipled frequent amendments. The government`s emphasis on the resource recycling has not been fully reflected through legislation. Many important definitions are still the Waste Management Act. Current disorder within this field could be improved through reorganizing the legal framework with the Resource Savings and Recycling Enhancement Act at the center. The terms such as `waste` and `recycling` should be relocated within the Resource Savings and Recycling Enhancement Act. The definition of waste should be cleared. Any material which was reused or recycled should not be considered as waste. Such materials should be considered as `recyclable resources` which is less heavily regulated. At the same time the definition of `waste` should be cleared and narrowed which is appropriately treated and ultimately buried in the sanitary landfill.
