이주노동자권리협약의 자유권 쟁점 -추방과 신체의 자유를 중심으로- = Critical Issues on Rights to Freedom under the Int`l Convention on Migrant Workers: Expulsion and Right to Liberty

다국어 초록 (Multilingual Abstract)

On December 18, 1990, the United Nations(UN) has adopted International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families(Int`l Convention on Migrant Workers: ICMW) in order to prepare a legal basis for protecting migrant workers in international level. The ICMW entered officially into force on July 1st, 2003, but the Republic of Korea does not yet ratify it. Considering the actual reality that the migrant workers over 600,000 persons stay in our country, it is necessary to discuss the legal issues on the ratification of the ICMW. The main issues will be especially concerned with the compatibility between the korean domestic law and the ICMW. Therefore this article examines some critical issues concerned in particular expulsion and right to liberty among the rights disposed under the ICMW. After study problems on the definition of migrant workers and its interpretation in the chapter 2, we will analyse two issues about expulsion and rights to liberty in the chapter 3 and 4. And, in conclusion, we will try to find out the reason that the developed countries including the Korea in the case of the European Union avoid to ratify the ICMW.
