북한의 국제범죄 확산과 전망 = The Proliferation and Prospect of International Crime of North Korea

국문 초록 (Abstract)

국제조직범죄 관점에서 북한이 야쿠자, 마피아, 삼합회 등 국제범죄조직과 구별되는 특성은 ‘조직’이 아닌 ‘국가’라는 것이다. 범죄주권을 가진 북한의 불법적인 활동은 주로 ‘39호실’이 관여하고 있으며, 마카오가 중요한 활동무대이었다. 북한은 국제범죄조직과 연계하여 노출 위험을 감소시키고 있다. 통계자료에 의하면 북한은 만성적인 무역적자를 보이고 있다. 북한의 수출입 규모는 글로벌 금융위기와 UN의 대북제재로 감소하고 있다. 계속되는 경제여건의 악화로 북한은 근로자 해외송출, 카지노 운영, 해외 식당사업, 마약 등 불법과 합법적인 모든 영역에서 외화벌이 사업에 적극적으로 관여하고 있다. 북한의 국제범죄 실태를 분석한 결과, 국제환경의 변화에 따른 불법적 외화벌이 적극 추진, 국제범죄를 통한 수익비중의 증가, 국제범죄 주체의 다양화, 국제범죄조직과의 연계, 국제범죄를 위한 서식지 증가, 부정부패를 통한 국제범죄 증가, 김정은 정권의 외화벌이 급감, 사이버공격을 통한 수익창출 모색 등의 특성이 나타났다. 이에 따라 북한의 국제범죄를 전망하면 다음과 같다. 첫째, 북한의 국제범죄는 수익창출과 외화벌이에 중요한 수단으로 절대 사라지지 않을 것이다. 둘째, 북한의 국제범죄는 김정은의 정권유지를 위해 기존과 다른 방법과 수단으로 확산될 것이다. 셋째, 북한의 국제범죄는 대북제제로 더욱 음성적으로 전개될 것이다. 넷째, 북한의 국제범죄 주체는 다양한 계층으로 확산될 것이다. 다섯째, 북한과 외국의 범죄조직과의 협력은 더욱 확대될 것이며, 국내 폭력조직이나 범죄조직과 연계 가능성도 예상된다. 여섯째, 북한의 국제범죄의 통로는 내부의 시장과 국경인접지역인 경제무역지대로 집중될 것이다. 일곱째, 북한의 부정부패로 인해 국제범죄는 확산될 것이다. 마지막으로 북한의 국제범죄 분야는 사이버를 통한 도박으로 확대될 것이다.

다국어 초록 (Multilingual Abstract)

A review of a preceding research reveals the feature that distinguishes North Korea from the international criminal organizations such as Yakuza, Mafia, Triad is that North Korea is not an organization but a nation. Primarily, Office #39 is involved in the illicit activities of North Korea which has criminal sovereignty. And Macao has been a significant stage of operations. North Korea decreases the risk of exposure by using the connection with the international criminal organizations. Nowadays, the number of trading partners of North Korea is decreasing. The proportion of North Korea`s dependence on trade with China is too outstanding to be challenged. North Korea`s export, which only deals with minerals and has no ability to treat other kinds of goods, has a structure vulnerable to external shocks. Constant deterioration of North Korea`s economic condition makes it actively involved in all kinds of activities for earning foreign currencies, whether it is legal or not, such as sending workers abroad, running casinos, restaurant business in foreign country, operation related to narcotic. The outcome of analysing North Korea`s international crime reveals its features, including aggressive propulsion for illicit activity to earn foreign currencies following the change of the international environment, the increase of earnings by international crime, diversification of performer of international crime, connection with international crime groups, the increase of habitat for international crime, the increase of international crime by corruption, the rapid decrease of Kim Jong-un regime`s earning foreign currency, groping for creating profit by cyber attack. Accordingly, the prospect of North Korea`s international crime is as follows. First, international crime by North Korea will never disappear because it is a significant means for creating profit and earning foreign currencies. Second, North Korea`s international crime will expand beyond existing method and means to maintain Kim Jong-Eun`s regime. Third, restriction on North Korea will make its international crime more covert. Fourth, more diverse classes will be involved in international crime as performers. Fifth, the connection with international criminal groups will be more expanded, and the possibility of connection with domestic criminal organization or violent organization is expected. Sixth, passages for North Korea`s international crime will be concentrated in inner market and economic trade zone which is adjacent to the border. Seventh, North Korea`s international crime will be expanded by its corruption. Finally, North Korea`s international crime will include gambling through cyberspace.
