『檢考』, 19세기 전반 지방관의 檢屍 지침서 = Kumko, A manual of Autopsy for the Local Officials in Early Nineteenth Century, Joseon

Kumko which was published in the first half of the 19th century is a book which summarizes the autopsy method and the specific method of writing the post-mortem examination for local officials of Joseon. Currently, this book is housed in Asami Collection of the U.C Berkeley. Since early Joseon, local officials of Joseon had to report to the ruling office by publishing a report after investigating the case according to the Muwonnog when a murder case happens. While Muwonnog contains the overall guidance of the murder investigation process, basically there are numerous information focusing on the autopsy skills and the determination of the cause of death. As a result, it was not enough from the perspective of local officials who needed to write postscripts and complete the examination report after the autopsy and interrogation. For local officials, specific information such as what should be noted in particular in the autopsy process and how to write the postscript or the sequence of the examination was needed. The author of Kumko seems to understand such issues by himself while serving as a local official. The author provides the detailed knowledge such as receiving the case, inquiry method, on-site management, limits of torture for confessions, managing method of dig inspection and possessions and furthermore writing the postscript and examination report based on own knowledge. In this sense, Kumko is seen as a unique book which specifically summarizes the murder case investigation progress and the examination method of the late Joseon Dynasty and also it is clear that this is an interesting data which allows us to see the detailed and actual contents on the murder case investigation of the late Joseon.

국문 초록 (Abstract)

19세기 전반 편찬된 ≪檢考≫는 조선의 지방관들을 위해 검시법과 검안 작성의 구체적인 방법을 정리한 책이다. 현재 이 책은 미국 버클리대학 아사미문고에 소장되어 있다. 鮮初 이래 조선의 지방관들은 살인사건이 발생하면 ≪無寃錄≫에 따라 사건을 조사한 후 보고서(檢案)을 작성하여 관찰사에 보고토록 했다. ≪무원록≫에는 살인 사건 조사과정의 전반적인 지침이 수록되어 있지만, 기본적으로 ‘檢屍의 기술과 死因의 확정’에 치중한 정보들이 많다. 그 결과 檢屍와 審問 이후에 구체적으로 跋辭를 쓰고 檢案을 완성해야 하는 지방관의 입장에서는 충분치 않은 느낌이었다. 지방관들에게는 검시과정에서 특별히 주의할 점은 무엇인지, 발사의 작성법이나 검안의 순서를 어떻게 할 것인지에 관한 구체적인 정보들이 필요했다. ≪검고≫의 저자는 스스로 지방관을 역임하면서 이러한 문제의식에 공감했던 것으로 보인다. 저자는 자신의 見聞을 토대로 사건접수에서부터 탐문법[廉察], 현장관리, 자백을 위한고문의 한계, 掘檢과 法物의 관리법, 나아가 발사와 검안 작성의 구체적인 지식을 제공하고 있다. 이 점에서 ≪검고≫는 조선후기 살옥 조사과정과 검안 작성법을 구체적으로 정리한 유일한 책으로 보이며, 아울러 조선후기 살인사건 조사의 구체적이면서 실질적인 내용을 확인할 수 있는 흥미로운 자료가 분명하다.
