보건의료인은 보건의료에 관한 전문지식을 갖추고 보건의료행위를 함으로써 사람들의 건강수준을 유지 및 증진시키는 중요한 역할을 한다. 그렇기 때문에 자율적인 통제장치나 규율체계를 갖추고 보건의료서비스를 제공하려는 경향이 강하다. 그러나 국가는 모든 국민의 건강과 안녕을 보장해야 할 책무가 있기 때문에 보건의료분야에 대한 통제를 하게 된다. 이와 같은 국가의 보건의료인에 대한 통제는 법률에 근거한 규제에 따를 때 정당성이 있다. 그러므로 여러 법률에서 보건의료인에 대한 규제 장치를 두고 있다. 이 연구에서는 먼저, 보건의료 및 보건의료인에 관련된 논의와 그 범위, 규제에 관한 이론 그리고 일본법령에 따른 보건의료인에 대한 규제를 고찰하였다. 그 다음에 연구대상인 보건의료인을 「의료법」의 의료인, 「응급의료에 관한 법률」의 응급구조사, 「의료기사등에 관한 법률」의 의료기사등으로 한정하여 이들에 대한 법적 규제를 위 3 개 법률의 현행 법령과 연혁 법률에 규정된 것을 중심으로 분석하였다. 위 분석은 보건의료인별로 진입규제, 금지의무관련 규제 및 행정의무 확보를 위한 규제로 나누어 이루어졌고, 보건의료인별 법적 규제의 차이점과 공통점 그리고 개선할 점 등을 제시하였다. 동시에 1993년 문민정부 이후 연혁법령상 보건의료인에 대한 규제의 변화를 분석하여 각 정부별 보건의료인에 대한 규제 변화와 정부의 간여정도를 비교하였다. 보건의료인에 대한 법적규제를 현행법령, 연혁법령, 그리고 일본법령의 경우와 비교한 결과, 우리나라의 보건의료인에 대한 법적 규제는 보건의료인별로 규제 건수에 있어서 차이가 크고 유사한 제도임에도 불구하고 다르게 규정되어 있는 경우도 있으며, 보건의료인에 대한 정부의 개입정도가 높은 것으로 나타났다. 이 연구는 다른 연구에 비해 보건의료인에 대한 법적규제 현상을 다각도로 분석하였다는데 의의가 있으나, 문헌조사로 이루어져서 보건의료인들이 실제 체감하는 규제수준과는 다를 수 있다는 한계가 있다. 그러므로 앞으로 보건의료인에 대한 법적 규제에 대한 연구가 보다 실증적이고 과학적으로 이루어져야 할 것이다. Health and medical service personnel is doing an important role by maintaining and improving health of the people and by providing health and medical treatment for patients. Therefore, the health and medical service personnel prefers to render health service under the control system. However, the government tends to control tightly the area of health and medical treatment since it has responsible for the health and wellbeing of the people. As a result, there are many Acts which aim to control the health and medical service personnel. This study focuses on the content of health-medical treatment, the scope of health and medical service personnel, and the concerned regulations on the health and medical service personnel prescribed in the Acts, such as are Medical Service Act, Medical Technicians, edt. Act, and Emergency Medical Act. This Study also focuses on the changes of the regulations of the above Acts since 1993, and additionally makes a comparative study between Korean Acts and the Japanese's regulation in relevant Acts. The result of the study shows that the numbers of the regulations are different between health and medical service personnel. Even if contents are same in Act, some regulations are applied differently according to health and medical service personnel. The result also shows that the government intervention of the state in the field of medical service personnel ie. M.D. is relatively high in comparison with other health-medical service personnel. Korean Acts in the field of health and medicine have much more regulations than Japanese relevant Acts. This study has done an in depth research on the legal regulations of the health and medical personnel in various ways compared with other study in the field of the health and medicine. But this study has limit of being researched only by the literature survey. I hope there will be a much more developed empirical and scientific study on this field of health and medical personnel.
