영국은 강력한 규제와 규제준수 보장 체계를 통하여 식품 공급망 전반에 걸쳐 높은 수준의 안전성과 품질을 유지하는 것으로 정평이 나 있다. 스코틀랜드 식품기준청(FSS)은 식품 및 사료 안전과 관련된 공식 통제를 시행하기 위하여 잉글랜드, 웨일즈 및 북아일랜드의 관할 당국과 협력한다. 각종 식품 안전 사건과 사고 그리고 변화하는 글로벌 시장에 대응하기 위하여 FSS는 가장 효과적인 식품법 집행 방안을 모색해왔다. 본고는 식품법 준수 보장 체계가 변화하게 된 배경 그리고 식품법 관리 체계 현대화를 위하여 FSS가 개발한 솔루션을 소개한다. 특히 FSS는 가용한 법집행 자원을 최적화하기 위하여 혁신적인 규제 수단을 개발하였다. FSS는 식품법(식품 위생, 식품 사기, 진위성, 이력추적, 라벨링, 식품 성분 등) 준수 실태와 업종에 따라 당국의 개입 우선순위를 지정하기 위하여 FLRS를 개발하였다. 또한, 삼각측량(OVC 조사, FCMS, 현장 확인)과 갭 분석 기법으로 구성된 OCV 시스템은 시스템과 사업자를 관리 가능한 단위로 세분화하여 식품통제관리시스템을 검증한다. FSS가 지역 당국과 공동으로 개발한 FLRS와 OCV는 스코틀랜드 전역의 관할 당국이 공식 통제를 체계적이고 투명하며 일관적으로 시행할 수 있도록 설계되었으며, 다양한 유형의 식품 관련 활동과 변화하는 식품 환경에도 적응할 수 있다. 향후 FSS는 식품법 집행자원을 확충하고 식품사업자의 자체 진단을 확대하며 맞춤형 개입을 강화하고 디지털 솔루션을 도입하는 방향으로 규제 환경을 개선해 나갈 것이다. The UK is known for its high standards of safety and quality across the food chain that is supported by a robust regulatory and assurance framework. Food Standards Scotland works in collaboration with other competent authorities across the UK to provide delivery of official controls in relation to food and feed safety. In response to food safety incidents and events, and changing world markets, it has been necessary to evolve and adapt to meet those deman ds i n t he most effective way. T his paper describes some o f the drivers for change and the solutions developed to address the needs of a modern food law control system. The need for change has provided opportunities to be innovative in developing new tools to optimise resources. The food law rating system is used to prioritise interventions of busin ess accordin g to c ompliance w ith the en tire s cope of f ood law (hygiene, food fraud and authenticity, traceability, labelling and composition) and business type. Official control verification uses triangulation and gap analysis to verify food control management systems, breaking the system and business down into smaller, more manageable sections. Both systems have been developed with local authorities in Scotland and have been designed to provide methodical, systematic, transparent and consistent official control delivery, which can also be adapted to accommodate different types of food activities and circumstances, and a changing food landscape. Future development is set to continue to increase resource capacity, increase business self-service systems, further improve targeting of interventions and implementation of digital solutions.

맞춤형 건강기능식품 활성화를 위한 규제 검토 및 개선방안 제언

“맞춤형 건강기능식품”이란 개인별 식습관, 생활습관, 건강검진, 유전자 검사 결과 등을 분석하여 개인에게 필요한 건강기능식품을 소분하거나 조합한 제품을 의미한다. 현행법상 건강기능식품의 소분 행위는 금지되나, ‘개인 맞춤형 건강기능식품’ 시범사업이 규제샌드박스 실증특례 대상으로 선정됨에 따라, 건강기능식품 소분과 맞춤형 건강관리 서비스 제공이 가능해진 것이다. 고령화 등의 사회적 현상과 예방 중심의 건강관리 트렌드에 따라 맞춤형 건강기능식품 판매에 대한 관심과 수요가 점차 증가하고 있으나, 과거에는 불가능했던 “개인 맞춤형” 형태의 영업으로 인해 정부와 업계, 소비자 모두 혼란을 겪고 있는 상황이며, 이러한 형태의 영업을 합법적·지속적으로 수행할 제도적인 기반 역시도 부재한 상황이다. 따라서 본 연구에서는 맞춤형 건강기능식품을 추천·상담하고 소분·판매하는 과정에서 적용되는 법률과 규제에 대한 검토를 수행하고, 사업의 지속적 운영을 위해 필요한 법·제도적인 개선방안을 제언함으로써, 맞춤형 건강기능식품 시장의 활성화 및 소비자 안전과 신뢰 확보를 위한 정책 개발에 기여하고자 한다. Personalized dietary supplements encompass products tailored by analyzing an individuals dietary habits, lifestyle, medical examination results, and genetic test data to customize the combination of required dietary supplements. While prevailing regulations currently prohibit the portioning of dietary supplements, the establishment of the Personalized Dietary Supplement Product Pilot Project as a special case within the regulatory sandbox demonstration has enabled the portioning and distribution of personalized health care services. The burgeoning social phenomena of an aging society and a shift toward prevention-oriented healthcare have amplified interest and demand for personalized healthcare products. However, the introduction of the “personalized” sales model, previously unattainable, has led to a state of confusion among government, industry, and consumers. Presently, there exists no institutional framework to support the legal and sustainable conduct of such sales. This study aims to comprehensively review applicable laws and regulations governing the processes of recommending, counseling, portioning, and distributing personalized dietary supplements. By identifying legal and institutional enhancements necessary for ongoing business operations, the study aspires to contribute to the formulation of policies that will stimulate the personalized dietary supplement market. Furthermore, through a thorough examination of laws and regulations governing the recommendation process, the study seeks to ensure consumer safety and trust, ultimately fostering the development of policies to invigorate and sustain the personalized dietary supplement market.
