헌법 제1조의 민주 개념에 대한 제헌국회의 상충적 이해: 공화 개념과의 관계 설정 문제와 그 역사적 기원

본 연구는 제헌헌법이 제정되던 1948년 당대의 맥락에서 제헌헌법 제1조의 ‘민주공화국’에 담긴 민주 개념의 의미를 파악하고자 한다. 그리고 이것을 제헌국회 이전의 민주 개념 이해와 연결시킴으로써, 제헌국회의 민주 개념 이해가 형성된 역사적 배경을 살펴본다. 구체적으로 이 연구는 ‘민주공화국’ 규정에 담겨 있는 민주 개념의 의미를 파악하기 위하여, 민주와 공화 개념을 구분하고 공화 개념과 대비하여 민주 개념이 갖는 의미상의 관계를 분석하고자 한다. 이를 위해서 제헌국회의 속기록에 등장하는 국체(國體)와 정체(政體)라는 헌법학적 개념을 활용하여 민주와 공화라는 두 개념이 어떻게 상호 이해될 수 있는지를 살펴보고, 이러한 이해들이 나오게 된 역사적 배경들을 그 이전의 텍스트를 통하여 검토한다. 결과적으로 본 연구는 민주공화국 규정에 포함된 민주와 공화 개념 간의 관계를 제헌국회 내부에서 대체로 두 가지 서로 다른 방식으로 이해하고 있었으며, 각각의 이해 방식은 나름대로의 고유한 역사적 형성 배경을 가지고 있다고 주장한다. This study explores the contending meanings of ‘democracy’ in the term ‘democratic republic’ of the first article of the 1948 founding constitution of Korea, as well as their historical origins or backgrounds. It draws largely on the official minutes of the 1948 constitutional assembly and the much earlier historical materials and texts. It assumes that to better understand the meanings of democracy, it is important to distinguish the concept of democracy from that of republic. This conceptual distinction is based here on the two independent constitutional concepts, ‘form of state(staatsform)’ and ‘form of government(regierungsform).’ We find that there are largely two contrasting understandings of the conceptual relationship of ‘democracy’ with ‘republic’ in the 1948 constitutional assembly, and that either of them has its own interesting historical background.
