        Korea has a short history in Democracy. The most decisive factor which disturbs the development of democracy is lack of democracy consciousness. Dasan`s legal thought is that propulsion of legal administration and criminal law among kingdom system makes modernization. Dasan`s three books(Kyung se you pyo, Mok min sim seo, Hum hum sin seo) analyze Korean unreasonable thought and propose proper counterplan. The book ``Kyung se you pyo`` is composed of the reorganization of national organization, improvement of personal affairs, establishment of finances, and development of economy. His book ``Mok min sim seo`` is written that he presented the present administration policy after observing desolation of country and impoverished life of the people. ``Hum hum sin seo`` grasped the real cases of Korea and China. In confucian society, a realist Dasan estimated heriditary monarch system nagatively, and protected election monarch system. Dasan emphasized politics in the first consideration of people.

        발표논문(發表論文) : 파리장서사건의 법적 성격

        This paper is intended as a legal investigation of the characters on the petition of the Korean Confucians to the Paris Peace Conference. It had been reported that 137 confucians signed on the petetion. The confucians who wrote their signature on the petetion belonged to several famous confician schools. The signatories were the representatives of Korean confucian schools. Changsha Takong Bao reported in full about the cause of The March First Independence Movement. Notwithstanding, the report gave prominent coverage about The National Self Determination of Thomas Woodrow Wilson. Also such newspaper reported in full about nationwide scale the process of development include demonstration aspect and the suppression of The March First Independence. Wilson Declaration article 5 is as follows: A free, open-minded and absolutely imperial adjustment of colonial claims and rivalries based upon the principle of the interests of both the colonial peoples involved and claimant powers. The term self-determination has been used for political and legal causes. The cincept of self-determination was one d\of political and ideological bases for the American independence movement and the French REvolution. Conclusionally, Self-determination is a right erga omnes and accepted as a principle of international law. According to the UN, it is a concept to be used to liberalize the people under colonial regime or foreign domination. To make a long story short, The Paris Longletter made a public disclosure of the Japan`s invasion and appealed to the Korean Independence.

        연구논문 : 그리스 민주정치와 선거제도 - 아테네 민주주의의 형성과 추첨제를 중심으로 -

        선거일이 임박한 시기가 되면, 우리나라 정치권에서는 유독 국민의 의사를 반영하기 위한 후보자 추천방안들이나 정책들을 포효하듯이 제시하곤 한다 이러한 현상은 우리나라에서 국민주권에 근거한 민주주의의 실현이 선거라는 제도에 의해서 구체적으로 실현되고 있다는 것을 보여주는 한 단면이기도 하다. 아테네 민주주의에서의 사용되었던 추첨제도는 민주주의에서의 근본이념인 자유와 평등을 구현시킨 제도로서 그 의미가 크다. 고대 그리스에서 추첨을 민주주의의 핵심제도로 인정한 이유는 민주주의 어원이 의미하는 대로 ‘데모스(demos, 전체인민)가 자기 스스로 통치(kratos, 지배)하는 체제’로 인식했기때문이다. 아테네의 경우에는 기원전 7세기 후반 평민들의 경제력이 성장되고 군사적 역할이 확대됨에 따라서 그들의 정치참여에 대한 요구가 증대되었다. 이러한 요구는 당시의 지배세력인 귀족정의 구성원이 귀족세력을 위협하게 되었다. 이와 같이 귀족과 평민이 대립을 하는 과정에서 참주들(tyrants)이 등장하였으며, 기원전 6세기 초 솔론(Solon)이 조정자로서의 개혁을 실시하였다. 페리클래스(Pericles)의 개혁은 아테네 민주주의의 정체성을 확립시키면서 대중 또는 인민이 정치의 주체가 되는 민주주의 장을 펼쳤다는 평을 받고 있다. 페리클레스는 배심원, 500인 평의회 의원 기타 추첨에 의해 임명된 공직자 등에게 국가 수입으로 공무수당을 제공하는 법안을 통과시켰다. 공무 수행에 지급되는 수당은 가난한 시민들에게 공공의 정치적 활동에 적극적으로 참여할 수 있는 기회를 제공하였다. 공직수행에 지급되는 수당은 아테네 민주주의의 확대와 유지에 기여하였다는 평을 받는다. 아테네 민주주의에서 주목해야 할 것은 평등과 자유이다. 먼저 평등으로서의 법적 평등의 개념인 이소노미아와 연설의 평등인 이세 고리아의 개념은 귀족적 가치를 내포하였다. 아테네인들은 자유의 개념을 참주정체에 대한 투쟁을 통하여 획득하였다. 이소노미아와 이세고리아에 기반을 둔 자유시민의 민주적 개념은 시민의 정치적 정체성과 밀접히 관련되어 있다. 특히 민주주의에서 보장된 자유는 주로 정치적 영역에서 전체 공동체의 집단적인 기능으로 작용하였다. 고대 아테네 경우 민호와 평의회, 배심원으로 운영되는 법원과 행정관인 공직자가 중요한 정치적 기능을 수행하였다. 그 구성원들을 선택하는 방법으로는 추첨이 사용되었다. 아테네 민주주의에서 중요한 역할을 담당한 추첨은 근본적인 민주주의적 가치를 반영하고 있다. 추첨은 권력의 독점을 방지하고 특정세력의 확장을 방지하기 위한 방법으로 관직 교체의 원칙에 잘 부합한다. 그리고 무엇보다도 추첨은 소수 엘리트 중심의 정치에 대한 민주주의자들의 깊은 불신에 반응할 수 있다. 이와 같은 추첨의 매력과 의의가 대의제 민주주의 체제인 현재에 와서도 대표 선발 방법인 선거제도의 보완적 수단으로써 그 적용 가능 여부를 지속적으로 제기하도록 만드는 원동력이 아닌가 생각한다. Our political authorities present candidate recommendation devices or polices for reflecting opinions of people when the day of election approaches. Such a present state of affairs shows that the realization of democracy on the basis of people sovereignty comes true by system of election. Lotto System used in Athena democracy has a great meaning in realizing freedom and equality which are origin idea in democracy. The reason of recognizing lotto by the core system in Ancient Greece is that demos was recognized as system of Kratos by himself. In Athena, requirement of political participation was become larger in according to economic growth and enlargement of military roles in the end of 7th century B.C. In the course of opposition of the nobility and commoners, tyrants appeared and Solon enforced reformation in the beginning of 6th century B.C Reformation of Pericles formed democracy by establishing government system of Athena democracy. Pericles passed a bill that he offers official allowance to a jury, five hundred councilors, and officers appointed by the others lotto. The allowances for official affairs offered the chance to participate in public political activities to poor citizens. They contributed to enlargement and maintenance of Athena democracy. The keypoint of Athena democracy is equality and freedom. Isonomia and Isegoria, the notion of legal equality, the notion of speech equality included the noble value. People of Athena acquired the notion of freedom through the struggle against tyrant system of government. Democratic notion of free citizens on the basis of Isonomia and Isegoria has a close connection between political system of government. Especially, freedom guaranteed in democracy operated as the group function in political area. In the ancient Athena, the lawcourt managed by councilors and a jury, and officers acted the important political function. Lotto was used as the method to choose the organization members. The lotto playing an important role in Athena Democracy reflected a radical democratic value. Lotto is identical to the principal of exchanging government service as a method to prevent monopolistic power and enlargement of specified power. Above all, lotto reflects mistrust of democratic against policy of elites. Such a charm and meaning of lotto initiate applying sustainingly as a method of election system to the present of democratic system.

        중국반독점법의 제정 과제 -한중 반독점법 비교

        China`s current competition policy is found in a number of specific laws and administrative rules. The most comprehensive of these is the Anti-Unfair Competition Law, promulgated in 1993. The Anti-Unfair Competition Law contains some provisions that are usually found in antitrust law, such as prohibition of tie-in sales in Article 12 and prohibition of price fixing and bid rigging in Article 15. But the Anti-Unfair Competition Law also adresses many other issues, including bribery, deceptive advertising, coercive sales, and appropriation of business secrets. To a large extent, the Anti-Unfair Competition Law is more like a consumer protection law than an antitrust law. In deciding how to approach administrative monopolies in the new antitrust law, China`s antitrust policy makers face a real dilemma. On one hand, as the ubiquity of administrative monopolies has made administrative monopolies the major source of monopolies in China economy, China`s antitrust policy makers feel obliged to address administrative monopolies in the new antitrust law. Many commentators believe that without provisions prohibiting administrative monopolies, the new antitrust law would necessarily be incomplete and would lose much of its relevance. Furthermore, without a chapter on administrative monopolies, the public may believe that the government does not have the resolve to fight monopolies at all and may discount the credibility of the other provisions of the law. On the other hand, prohibiting administrative monopolies in the new antitrust law will almost certainly yield few successes in the near future, given China`s current economic and political realities. Monopolistic problem in China cannot be solved by only making a antitrust law. Adiministrative monopolistic problem including the cultural, historic, ethical, structural factors includes a adjustment of interests between the central government and local government. The fundamental solution must be made in the dimension of the constitutional law. Only a antitrust law can be limited because local government is both one of the political organization and economic organization in China`s current system. According to the development of innovation and opening courses, China has begun an importance of economic democratization. In the case that the market problems occur, it is limitted for the enterprise to solve them in the boundary of market because administrative influence is still absolutely strong and the enterprise and government is inseperably related to each other in China. In other words, monopolic problem in a fish market is not solved by a competition principle of a fish market, itself, but a tendency depending on a political party clerk remains until now in China. Therfore in the current point that the antitrust law is established and enforced, it will be a future task that a creative application of an exclusive institution that is guaranteed an independency by a law, and also in real, and the establishment of more compositional legal economy articles.

        연구논문(硏究論文) : 미공개 정보 이용행위의 금지

        Insider trading problem is the most provocative and baffling aspect of the securities field. In ordinary usage, insider trading is said to occur when a person buys and sells securities of a corporation on the basis of material information. the prohibition against insider trading-the rule that certain persons with knowledge of material, nonpublic information about a company`s stock must either disclose that information or refrain from trading is now a tenet of antifraud ideologe under the federal validity has been accepted as a matter of by the courts and the Securities and Exchange Commission in the United States. Persons in a position to have special access to confidential information bearing on the value of a security are perceived as being unjustly enriched when they trade with others who are unable to discover that information. U.S. section 10 (b) of the 1934 Act and SEC Rule 10 (b-5) thereunder have evolved into the principal limitations on trading on the basis of material, nonpublic information. Under rule 10 (b-5), the gravemen of the violation is not the trading but the failure a duty to disclose when there is such a duty in connection with the trading. In the leading case of SEC v. Texas Gulf Sulphur Co., the Second Circuit articated the rule as follows: Anyone in possession of material inside information must either disclose it to the investing public, or, if he is disabled from disclosing it, or he chooses not do so, must abstain from trading in or recommending the securities concerned while such inside information remains undisclosed. The Second Circuit subsequently held that persons in possession of material, nonpublic outside, or market, information were also subject the same duty to disclose or abstain. Conclusionally, it is necessary to establish the securities ombusman system, incentive system, timely fair disclosure policy, etc.

        공서양속의 판단과 적용

        Korean Civil Law section 103 provides that a legal action with the object of violating good customs or social order is invalid. Japanese Civil Law section 90 provides that a legal action with the object of violating public order or good customs is invalid. We can say this a standard of the public order and good customs. Such a feature of the public order and good customs is that the effect of a legal action depends on the inclusive condition of the public order and good customs. These days the standard of the public order and good customs is widely applied day by day. So the necessity is admitted in the trade relation, labor relation, monopoly regulation and fair trading relation. Ultimately the public order and good customs is required for realization of constitutional value. The public order and good customs which is provided in a civil law section 103 is abstract and not clear. But it has two practical functions in the problem of violating the public order and good customs and applying. And the society order in a civil law has the private order and the expansion of modern international relation. Consequently there are the public order and good customs in a political society order, economic society order, cultural society order, and international society order. The unfair subcontract being discussed recently can be interpreted as a violation of the economic public order and good customs. In conclusion, the public order and good customs as a standard is the most valuable in the domestic and international society order. It depends on the peace and order in the inside and outside of the country for the realization. This is the subject of the future.
