Criminological theoretical approaches to digital music piracy

정보기술 산업이 빠른 속도로 발전되면서 오늘날 우리는 정보의 가치가 있는 자료의 검색 능력이 사회적, 경제적 경쟁력이 되는 정보화 사회에 살고 있다. 이로 인하여 인터넷을 사용하는 대중들은 다양한 온라인 콘텐츠에 대한 사실상 무제한적인 접근이 허용되고 있다. 그러나 한편 인터넷상에서 이용자들에게 다양한 문화 콘텐츠의 다운로드가 용이해짐으로써 디지털 저작권 침해 문제가 심각한 사회 문제로 등장하고 있다. 이와 같은 사회적 상황 아래, 미국에서는 오래전부터 디지털 저작권을 침해하는 사람들의 동기를 설명하는 형법학상의 연구가 여러 이론의 적용을 통하여 행해져 왔다. 특히 합리적 선택이론, 긴장이론, 자기통제이론은 인터넷상에서의 음악 저작권 침해 행태를 설명하는 주된 이론으로서 이용되어 왔다. 본 논문은 온라인 공간에서 음악 저작권을 침해하는 주된 계층이 젊은 세대라는 점에 주목한 세 가지 이론을 바탕으로 한다. 필자는 디지털 음악 저작권 침해행위와 세 가지 이론 간 상관관계를 설명하면서 이에 따른 잠정적 결론을 유도해보고자 한다. The information technology industry has been developing with rapid speed recently leading to an information-based society. So these days the public practically are able to access to multiple online contents without difficulty. However, the advantage of Internet has caused some problematic matters on digital piracy for society as well by facilitating downloading contents such as music, video, and literary works or something available on the Internet for free in the way of sharing between Internet users. Under this social circumstance, criminological researches in demonstrating intentions of committing digital piracy have been fruitful in the United States by an application of a couple of different theories. Especially rational theory, strain theory and self-control theory have been consistently applied to elaborate individual types of infringement in copyright for music on the Internet. Therefore, this paper would demonstrate the correlations between digital music piracy and those criminological theories suggesting the tentative conclusion based on the examination of them since it has been noticeably implemented in the cyber space mostly by young users a lot.

방송 프로그램의 제작과 유통 과정에 있어서 저작권 침해에 관한 시론적(試論的) 연구

?;?;본 논문에서는 방송 저작물의 제작 및 유통과정에 일어날 수 있는 저작권 침해 문제를 검토하는 한편 이 문제에 관한 대응방안의 모색하였다. 방송 저작물에는 다수의 권리자 및 이용자들의 권리관계가 복잡하게 얽혀있어 이로 인한 저작권 침해 문제가 불가피하다. 더욱이 인터넷의 보급의 보편화와 함께 인터넷 상 복제 및 전송이 자유로워짐에 따라 방송저작물의 저작권 침해가 더 한층 손쉬워졌다. 이에 따라 방송저작권보호를 위해 논의되고 있는 것이 기술적 보호조치이다. 국내에서 논의되는 것으로는 PPI 기반의 방송 프로그램 보호신호 송수신시스템 및 단말 플랫폼의 개발과 지상파 방송사가 OSP와의 합의를 통해 특징점(DNA) 기반의 콘텐츠 필터링 기술을 적용하여 사이버 공간에서 유통되는 방송 저작물을 보호하는 것 등이 있다. 아울러 해외의 기술적 보호조치 방안을 살펴보면서 이의 국내 도입 가능성 등을 논의해 보았다.<br/> This study reviews problems of copyright infringement that can be occurred in the process of production and distribution of Broadcasting Contents and suggest some solutions about these problems. It is inevitable to arise issues about copyright infringement caused by the fact that multiple people who have rights and users coexist in the Broadcasting Contents. Furthermore, it increases the rate of copyright infringement on Broadcasting Contents as reproduction and transmission became more practicable on the Internet due to the prevalent use of the Internet. For this reason, Technological Protection Measures are cross lips as methods for protection of Copyright Originating from Broadcasting. As the ways to protect it several solutions discussed in the country are as follows. Firstly, exchange subsystem of protective signal for broadcasting programs based on PPI and terminal platform should be developed. Secondly, it is needed to protect Broadcasting Contents distributed in the cyber space by introducing contents-filtering technology based on DNA after consultation between terrestrial broadcasting companies and OSP. In addition to these, whether foreign Technological Protection Measures could be adopted in the country is debated examining them.

한류 열풍에 힘입어 국내 방송 프로그램 포맷이 중국과 동남아시아 국가 등을 중심으로 수출되고 있지만, 실제로는 국내외 거래당사자들 사이에 보호의식의 결여와 합리적인 법ㆍ제도적인 대책의 미비로 인하여 포맷의 저작물로서의 각 지분권 보호가 이루어지지 않고 있어 이에 대한 대책 마련이 시급한 실정이다. 방송 프로그램 포맷도 단순한 `아이디어`의 수준을 넘어, 창작성을 갖춘 정교한 구성(format)이라면 저작권법상 보호받아 마땅한 `표현`으로 인정하여야 한다는 것이 본 연구의 잠정결론이었다. 이러한 전제 하에 유럽과 미국 등 해외의 포맷 저작권에 대한 입법 및 판례동향과 거래 현황을 분석하여 국내 방송 프로그램 포맷의 저작권법적 보호방안을 강구하려는 시도가 본 연구의 사직이자 목적이었다. 보호방안의 대안으로는 한국형 FRAPA 설립을 포함하여 사회적 인식제고와 법ㆍ제도적 대책 마련과 방송 포맷 전담기관 설립 및 전문가 육성 등이 제시되었다. This paper is fundamentally aimed to raise the necessity of copyright protection on Korean TV program formats, which will be called as K-formats, exported to foreign countries. When TV formats are detailed equipped with originality beyond the “idea” level, this must be considered as copyrighted work under proper protection. It is a tentative conclusion of this research and gathered opinions of some specialists and scholars related to broadcasting industry and legal fields. Under this premise, this research has started with purpose of devising appropriate measures to protect domestic TV formats pursuant to copyright act by analyzing legislations, legal cases, and business trends about TV formats copyright in abroad such as European countries including the United States. As alternative plans for copyright protection of TV formats of Korea, improving public awareness and establishing legal systems, training formats specialists including foundation of Korean FRAPA have suggested.
