본 연구에서는 생활 속 법 관련 경험을 수업에 도입하는 교수학습 방법 중 하나인 사례연구법의 개념, 특징을 문헌을 통해 고찰하고 이것이 지닌 한계를 드러낸다. 기존의 사례연구법은 인지적 측면의 발달에만 중점을 두고 있어서 인지적, 정서적, 행동적 측면의 고른 발달을 촉진하는 법교육을 실시하기에는 한계가 있었다. 따라서 본 연구에서는 이를 보완하기 위하여 학습자의 서사적 사고 작용을 촉진하고 법교육의 정서적, 행동적 측면을 고루 발달시킬 수 있는 서사적 관점을 사례연구법에 도입하겠다. 서사적 관점을 도입한 법교육 사례연구법은 기존 사례 연구법이 가진 한계를 보완할 수 있는 요소들-자신의 법적 경험을 수업 속에 많이 포함시킬 것, 학습자 자신이 법 이야기의 ‘저자’임을 강조할 것, 자신의 법적경험에 대해 타인과 논의하는 기회를 많이 제공함으로써 자신의 법적 가치를 검증받을 것, 획득한 법적 서사 관습을 실생활에서 연습하게 할 것, 법교육 수업에서 그러한 법적 서사표현활동(재판장이나 검사에게 편지쓰기, 모의재판 대본 만들어 보기, 역할놀이 대본 만들어보기 등)을 할 수 있는 다양한 방법을 개발할 것-을 포함하고 있다. 이는 법적 지식의 획득, 논리성 증진과 관련된 인지적 측면을 주로 발달시키는 기존의 사례 연구법을 보완하고 정교화할 수 있는 방안이 될 수 있을 것이다. 서사적 관점을 도입한 법교육 사례연구법은 다음과 같은 의의가 있다. 첫째, 법의식의 인지적 측면에서 학습자는 자신과 타인의 법적 경험에 대한 모방을 함으로써 구성적인 앎을 완성해 가며 자신의 ‘법 이야기’를 직접 만들어가는 ‘저자’가 될 수 있다. 둘째, 법의식의 정서적인 측면에서 학습자 자신의 경험을 서사화하는 반성적 성찰을 통해 자신을 타자화하며 나아가 서로의 입장을 공감해 보는 기회를 제공한다. 셋째, 행동적인 측면에서 학습자에게 법적 서사 관습을 형성할 수 있게 해준다. In this study, we contemplate the concept and features of the case study method in law-related education and expose the limitation of this method. Because the existing case study method has only cognitive effectiveness, it has a critical limitation. Therefore, in this study, we introduce the narrative point of view to the existing case study method to develop a narrative thinking of learner and emotional, behavioral side of law-related education. This method contain many elements that complement the limitation of the existing case study method. So, this new case study method in the law-related education will be a way to complement and sophisticate the existing case study method. And it has a Significance of Case Study Method introducing a narrative point of view in Law-Related education as follow. First, in the point of view of the cognitiveness side, the learner can be a writer complicating the story of their own imitating the people`s experience of legal. Second, in the point of view of the emotional side, it can provide the chance of reflection to make themselves strange and to sympathize other person`s status. third, in the point of view of the behavioral side, it can provide the narrative customs of legal to the learner.
