현재 우리나라 중소기업 사업영역 보호를 위한 제도로는 적합 업종제도와 사업조정제도가 있다. 그간 사업조정제도는 유통업 및 제조업 등 다양한 업종에서 대ㆍ중소기업간 갈등해소에 핵심적인 역할을 수행해 왔으나, 최근의 사업환경 변화에 따라 새로운 방향을 모색해야 할 필요성이 증대되고 있다. 우리나라 사업조정제도 관련 대ㆍ중소기업 상생협력 촉진에 관한 법률은 일본 사업조정법과 외형상 유사한 점이 없지 않다. 그러나 구체적 법조항의 내용과 법집행의 실태는 일본법과 매우 다르게 나타나고 있다. 본 논문은 이러한 관점에서 탐색적 연구를 통해 일본의 사업조정법의 현황과 특성을 살펴보고 우리나라의 현 사업조정제도와의 차이점을 분석해 보았다. 본 연구를 통해 우리나라 사업조정제도에 대한 네 가지 정책적 시사점을 도출하였다. 첫째, 지방자치단체 사업조정심의회 활성화, 둘째, 사업조정제도의 목표를 시장연착륙을 위한 제도설계로의 전환, 셋째, 사업조정제도를 통한 사업안정화로서의 정책기능 강화, 마지막으로 대기업과 중소기업 간의 상생관계로의 전환 등이다 Until now the business adjustment system has played a key role in resolving conflicts between large and small companies. However there is an increasing need to find new directions in response to recent business environment changes. The Japanese system is a good example of research in business adjustment sector. Comparing business adjustment system of Korea to that of Japan, they are similar, but different from the actual contents. The purpose of this paper is to study the current status and problems of the Korean system and to draw some implications from the comparison with Japanese system in business adjustment system through an exploratory study. Through this study, four policy implications for the business adjustment system in Korea were derived. First, it is necessary to revitalize local governments, business coordination councils. Second, the goal of business adjustment system should be shifted for soft landing in market. Third, the policy function should be strengthened as business stabilization through business adjustment system. Fourth, it is needed to be pursued a win-win relationship between large corporations and SMEs.
