여성주의법학은 여성주의법학자의 노력만으로 성취될 수 없는 통합적이고 학제적인 학문이다. 때문에 여성주의법학자 외부의 노력이 절실하다. 그러기 위해서는 여성주의적 관점과 여성주의법학의 논의를 총괄적으로 소개하는 글이 다른 법학과목보다 더욱 필요하다. 이에 본 논문은 이러한 맥락을 고려하여 여성주의법학은 기존 법학과 달리 성인지적 법학방법을 취하고 있으며, 기존의 법학방법론에 대한 대안적 법학방법론이라는 것을 개괄적으로 기술하였다. 이와 같은 맥락을 고려하여 제2장에서는 여성주의와 여성주의법학의 의미를 페미니즘의 여러 갈래와 여성주의법학과의 관계로 정리하였다, 이어서 제3장에서는 여성주의법학의 연구 방법이 기존법학방법이 중요하게 생각하는 합리성, 이성, 체계성, 논리성, 개념성과 달리 여성의 주체성, 경험, 고통을 중시하며, 이야기서술방식을 택하면서 정서적 공감을 법학의 중요한 방식으로 채택하고 있음을 보았다. 이러한 성인지적 법학방법을 통해서 여성주의법학은 성인지적 법담론을 구축하고 있음을 보았다. 기존의 법이 불평등과 평등을 축으로 하였다면, 여성주의법학은 보편성과 차이를 축으로 하고 있음을 보았고, 권리담론과 공/사의 구분에 대한 비판과 여성 몸의 표현방식에서 남성의 대상으로 간주되는 여성 몸의 격하에 대하여 고찰하였다. The feminists of the feminist jurisprudence belong to a fringe group in the law field. Because of this, the insiders of this sphere need to help outsiders to understand it. So this paper aims to introduce the feminist jurisprudence, especially for people next to nothing about that field. This shows wholly the difference between the feminist jurisprudence and the established jurisprudence for a long time. For this work, these are considered firstly what means the feminist jurisprudence and how can feminism or feminist thought relates to the feminist jurisprudence, secondly what is the different methodology between the feminist jurisprudence and the established jurisprudence, Women`s experience & pains and women`s identity signify in the feminist jurisprudence. It adapts storytelling and feeling sympathy to construct a gender cognitive legal theory. Finally in this paper the feminist jurisprudence means a practical jurisprudence which builds a gender cognitive and an alternative legal methodology.
