중국 법률석사 모의재판교과과정의 현황과 개선방향에 관한 고찰 - 대련해사대학교 사례를 중심으로 -

본 논문은 중국전업학위제도의 도입으로 시작된 법률석사교육과정의 필 수실무과목인 모의재판교과정 개선방향에 관한 연구논문이다. 논문은 먼저 법 률석사제도의 도입배경과 중국의 법률자격시험제도에 대하여 살펴보고, 법률 석사 모의재판교과과정 중 존재하는 연극식의 진행방식, 모의재판과정의 태성 적인 한계점, 법률자격시험과의 직접적인 연관성 부족으로 인한 학생들의 열의 부족, 모의재판교과과정에 필요한 연구와 교재, 재교육 프로그램의 부재 등 문 제점을 분석하고 이러한 문제점을 해결하는 방안을 제시하는 것으로 구성되었 다. 대련해사대학교 사례를 중심으로 고찰하였으나, 중국 법률석사 모의재판교 과과정의 전체적인 문제점과 해결책 모색을 목적으로 하였고, 전문교수와 겸임 교수가 공동으로 수업하는 방법을 통하여 모의재판교과과정의 교육효과를 향 상할 수 있다는 결론을 내리고 있다. This study is a research on the possible amendments that could be made for mock trial course in the juris master curriculum in China. Juris master program was introduced into China as a full-time law degree focusing on practical training for non-law students, and mock trial course is one of the core courses in the program. This study begins with a brief introduction about the background of how the juris master program was introduced into China and China’s legal qualification exam. It then identifies several problems of the mock trial course in China’s juris master curriculum such as the performance-like proceeding, the innate limitations accompanying the mock trial course, the lack of enthusiasm for students due to the lack of direct connection with the legal qualification exam, and the absence of relevant studies, textbooks and re-education programs necessary for the mock trial course. Next, this study provides various suggestions for solving the above mentioned problems. Even though this article focuses on the case study of Dalian Maritime University, its purpose is to find the general problems and solutions for all mock trial courses in China’s juris master curriculum. The final conclusion for this study is that the course should be run by the joint instruction of both full-time professor and adjunct professor with practical experience in order to enhance the education effect of the mock trial.
