UN 안전보장이사회 제재결의의 국내적 이행에 관한 한국의 법체계와 실행

UN 헌장 제7장에 근거하여 취하는 안전보장이사회의 결의는 국제평화와 안전 유지에 위협이 되는 행위를 자행한 국가나 비국가행위자를 ‘제재’하는 매우 유용한 수단이다. 한국에 직접적으로 위협이 되는 북한의 핵실험이나 미사일 발사와 같은 문제도 UN 안전보장이사회의 제재결의에 의해 다루어지고 있다는 점에서 안보리 결의의 실효적 이행은 우리나라에게도 매우 중요한 의미를 가진다. 그러나 안전보장이사회의 제재체제는 안보리의 결의채택과 회원국들의 국내적 이행이 함께 확보되어야 하는 이원적 구조를 갖고 있기 때문에 동체제가 실효성을 가지기 위해서는 국가들의 이행이 필수적이다. 이에 본 논문에서는 우리나라가 UN 안보리결의를 국내적으로 어떻게 이행하고 있는지 살펴보고, 국내이행조치의 실효성에 대해 검토하였다. 또한 기존법령에 근거해서만 결의 이행조치를 취하는 것에 대한 문제점을 지적하고, 이를 보완할 수 있는 개선 방안으로 수권법률의 제정을 제안 하였다. International community is facing threats such as spreading terrorist activities, unstoppable armed conflicts and development of weapons of mass destruction across the world, but it has no law enforcement body to control the threats and uphold international peace and security. Therefore, it desperately needs to take actions to end such threats. In this regard, the UN Security Council resolutions and sanctions regime under Chapter VII of the UN Charter serve as the most effective means to impose sanctions on individuals, parties or nations that threaten international peace and security. The UNSC sanction regime and its effective implementation in South Korea have significant meaning since the sanction regime is an essential instrument in dealing with North Korean issues such as North Korean nuclear and missile tests which directly threatens the Republic of Korea. It is noticeable that the UNSC sanction regime requires both UN Security Council to adopt and member states to implement the resolutions. To endure the effectiveness of the sanction regime, it is indispensable for member states to implement the resolutions at the national level. This paper focuses on examining the domestic mechanisms of how South Korea has implemented UN Security Council resolutions domestically. It also delves into specific measures that South Korea took to implement the sanctions resolutions in the country. Moreover, the paper includes analysis on legal basis and attributes regarding the implementation. The paper points out that it is not desirable that South Korea is implementing Security Council sanctions only in accordance with the existing Korean laws, and it proposes enacting prior- enabling legislation as an improvement action.
