한국 학교 법교육의 전개 양상

The purpose of this study is to describe developmental aspects of school-based law-related education(LRE) before and after the enactment of LRE Support Act in Korea. In order to achieve the purpose of this study, I started analyzing characteristics of excellent LRE programs in America. Then, I examined the historical backgrounds of school-based LRE in Korea. Finally, I investigated the current state of school-based LRE in Korea. The major results from this study are as follows. First, excellent LRE programs, as a result of a grassroots movement, focus on learning about street laws and legal concepts, include active learning with participation and action, promote the incorporation of law-related instruction in the existing curriculum, use outside resource persons, and provide teachers with continuing in-services. Second, the backgrounds of school-based LRE in Korea are based on the continued concerns of teachers on law studies, the separation of LRE from the political education, and the influences of American LRE. Third, school-based LRE in Korea is in two ways: traditional school-based LRE by the public schools, and school-based LRE by the Ministry of Justice. The former is pursuing street laws and students?participation, but it is negative about using outside resource persons and providing teachers with continuing in-services. The latter complies with characteristics of excellent LRE programs, but it is centered on the extra-curricular activities. In conclusion, through establishing a complementary relationship between traditional school-based LRE and school-based LRE by the Ministry of Justice, we must seek systematic methods for supporting LRE in the classrooms. 본 연구의 목적은 법교육지원법 제정을 계기로 한국의 학교 법교육의 전개 양상을 살펴보는 것이다. 이를 위하여 성공적인 법교육을 정착시켜 온 미국 학교 법교육의 대표적인 유형이 갖는 특징을 살펴보고, 한국 학교 법교육의 개괄적인 등장 배경을 검토하며, 미국의 학교 법교육 유형이 주는 특징적인 시사점에 터하여 한국 학교 법교육의 전개 양상을 분석해 보았다. 본 연구의 결과는 다음과 같다. 첫째, 미국의 학교 법교육은 풀뿌리 운동으로서 생활법과 법 개념, 학생의 적극적인 참여와 행동, 학교 교육과정에의 통합, 지역사회 인적자원의 활용, 지속적인 교사연수를 지향한다. 둘째, 한국 학교 법교육은 법에 대한 현장 교사들의 지속적인 관심, 정치교육으로부터 법교육의 분리, 미국 법교육의 영향으로 형성된 것이었다. 셋째, 한국의 학교 법교육의 전개 양상은 전통적으로 교과 활동 중심으로 생활법과 학생들의 참여와 행동을 지향하고 있으나, 지역사회자원 활용과 교사 연수가 미미하였다. 그리고 법무부의 학교 법교육은 생활법과 학생의 행동과 참여를 통한 법교육을 실행하고자 하며, 교재와 연계된 지속적인 연수를 하고 있으나, 비교과활동 중심의 학교 법교육을 전개하고 있었다. 이제는 전통적인 학교 법교육과 법무부의 학교 법교육의 관련성을 학교 현장을 중심으로 보다 면밀하게 분석하여 두 법교육의 상보적 관계를 설정하여 체계적인 실천이 모색되어야 할 시점에 이르렀다고 본다.

초등 사회과 교과서에 나타난 법교육의 변천: 인간의 존엄성 내용 진술을 중심으로

The purpose of this study is to review the transition of Law-Related Education(LRE) in Korean elementary social studies. In order to achieve this purpose, law-related contents in elementary school textbooks for the 4th, 5th, and 6th grade since 1946 were analyzed. For having a clear grasp of characteristics of LRE by the curriculum period, it was examined and compared how to be gave a description of the law-related theme -human dignity- that has appeared in textbooks for all periods of curriculum. The criteria of comparison and analysis were established by the legal reasoning mode which was constructed by deductive reasoning, analogy, inductive reasoning, and dialectical reasoning. Because the legal reasoning mode is a structure related with the legal norm and case that are based on contents for LRE. The major results from this study are as follows. First, LRE of elementary social studies in Korea was centered on legal norms and public law. Second, it was proceeding from legal norms-centered to cases-centered. But, the legal reasoning mode was restricted within the deductive reasoning or the inductive reasoning. For developing LRE of elementary social studies in Korea, we must make law-related contents learner-centered, story-centered, and Korean cases-centered. 본 연구에서는 한국 사회과에서 법교육의 변천 모습을 살펴보고자 하였다. 이를 위해 초등학교 사회과 교과서의 법 관련 내용의 분석을 시도하였으며, 교수요목기부터 제7차 교육과정기에 이르기까지 초등학교 사회과 456학년 교과서의 법 관련 내용을 분석의 대상으로 하였다. 각 교육과정기별 법교육의 특성 파악을 위하여 전 교육과정기 동안 지속적으로 등장한 주제들을 검토하고, 그 중에서 ‘인간의 존엄성’에 대한 기술을 문맥 단위로 비교분석하였다. 비교분석의 기준은 법교육 내용의 기반이 되는 법규범과 사실의 관련 구조인 법적 추론 방식을 중심으로 설정하였다. 본 연구를 통하여 나타난 한국 사회과에서의 법교육의 변천 경향은 첫째, 전반적으로 법규범 중심 또는 공법 중심적인 틀 속에서 내용이 구성되어 있었다. 둘째, 교육과정기를 거쳐 오면서 점차 법규범 중심에서 사실 및 사례 중심으로 나아가고 있으며, 법적 추론 방식은 연역적 추론 방식에서 귀납적 추론 방식으로 나아가고 있었다. 이상의 변천 과정에서 시사 받는 바는 법규범 중심에서 사례 중심으로 나아가되, 공법보다는 사법 및 학습자 중심의 내용 구성, 단편적인 사례가 아닌 이야기 중심의 내용 진술, 그리고 외국의 사례가 아닌 한국의 대표적인 사례의 제시로 나아갈 필요가 있다고 본다.

초등 사회과에서 법교육의 적용과 변천 - 미국 법교육이 주는 시사 -

The purpose of this study is to review law-related education(LRE) in United States, and to find directions of LRE in elementary social studies. In order to achieve the purpose of this study, I started analyzing history of LRE in the United States. Then, I examined the process of the changes and applications of LRE in elementary social studies. Finally, I found useful approaches to LRE in elementary social studies. The major results from this study are as follows. First, various LRE programs, with their own distinct goals, should be provided at elementary schools. Second, LRE contents should be organized around basic legal concepts. Third, LRE programs should include complex skills. Fourth, LRE classroom should establish an environment which mirrors and values the democratic practices taught throughout the law-related education curriculum. Fifth, LRE programs should be provides with one package unifying contents, methods, teacher training, and information center For invigorating school-based LRE after the enactment of LRE Support Act in Korea, we should be focusing efforts to evaluate exactly with these approaches. 본 연구의 목적은 성공적인 법교육을 실천해 온 미국의 초등학교 법교육을 맥락적으로 검토하여 초등학교 사회과에서 법교육이 어떻게 이루어져야 할 것인지를 알아보는 것이다. 이를 위해 미국의 법교육을 시대별로 개관해 보고, 초등학교 법교육의 적용과 변천 과정을 살펴보았으며, 이로부터 초등학교 사회과 법교육의 접근 방법에 대한 시사점을 도출해 보았다. 본 연구의 결과는 다음과 같다. 첫째, 각기 고유한 목적을 지닌 다양한 법교육 프로그램이 제공되어야 한다. 둘째, 법교육의 내용은 개념을 중심으로 구성되어야 한다. 셋째, 법교육 프로그램에는 복합적인 학습 기능(skills)들이 통합되어 있어야 한다. 넷째, 법교육 교실은 민주주의의 실제와 가치를 반영한 환경이어야 한다. 다섯째, 법교육 프로그램은 내용, 방법, 교사연수, 정보센터 등이 하나로 통합된 패키지 형태로 주어져야 한다. 법교육지원법 제정을 계기로 학교 법교육의 활성화를 시도하고 있는 시점에, 한국 초등학교 사회과 법교육을 위해 우선적으로 해야 할 일은 이러한 시사점에 터하여 현장의 모습을 정확하게 진단하는 일일 것이다.

책무성의 관점에서 본 초등 사회과 수행평가

This study has examined the present status of performance assessments in view of the accountability, focusing on the elementary school social studies. This study is based on thinking that performance assessment in social studies is a tool of improving the instruction. For this study, meaning of accountability, changes of accountability contents, and the relation between the accountability and the assessment was examined. In results, performance assessments in Korea play a role in realizing the professional accountability. For filling this roles of accountability, firstly, performance assessment has to be a frequent occurrence. Secondly, it must be enforced in diverse circumstances and methods. This two principles are directly associated with the 'instruction improvement'. On this two principles, performance assessments was analyzed. The consequences were as follows. First, frequency applying performance assessments to the instruction was decreased. It was not suitable to the first principle. Second, by the second principle, methods designing performance tasks in performance assessments were positive, and methods building performance criteria were both positive and questionable. Third, there must be some efforts to make designing performance tasks done in groups, scoring based on generalized criteria, and scoring with more complete descriptions of terms for the development of performance assessment in korean social studies.

사례연구법의 사회과 적용 과정 탐색 : 연구 방법론에서 법교육까지 from Research Method to Law-Related Education Method

본 고에서는 사회과 교육에서 특히 법교육에서 대표적인 수업기법으로 받아들여지고 있는 사례연구법의 교수론적 의의를 사례연구법의 교육적 변용 과정의 탐색을 통하여 확인해 보고자 하였다. 이를 위해, 먼저 본래 학문 연구 방법론으로서 사례연구법이 갖는 여러 가지 성격과 특성을 파악하고, 이들이 어떤 관점에서 교육적으로 활용되어 왔는지를 살펴보았다. 그리고, 우리의 사회과 법교육의 전개에 있어서 시사점을 도출해 보았다. 그 결과, 사례연구법이 학문 연구 방법에서 사회과 법교육의 수업기법으로까지 발전해 오기까지 지속적으로 그 유용성으로 확인된 것은 '탐구학습을 통한 일반화'와 '쟁점에 대한 활발한 토론 과정'이었다. 이러한 사례연구법이 갖는 교수론적 유용성은 한국 사회과 법교육이 그 동안의 내용 중심적 접근 방식에서 벗어나 방법 중심의 새로운 접근을 하여야 한다는 시사점을 던져 주고 있다. The purpose of this study is, by exploring the pedagogical transition process of the case method approach, to define the instructional efficiency of the case method approach in social studies. In this study, I extracted pedagogical implications from the case method approach as a research method. Then, through exploring what perspectives are reflected in its application, the guidelines for appling the case method approach to Korean law-related education in social studies education were proposed as two. The first one was I generalization through the inquiry teaching', which included both using the legal case for the integrated instructional materials and using the legal dilemma for self-directed learning, and the other was' active discussions on issues', which included both examinations for diverse viewpoints in legal cases and understanding of moral ideas behind a judicial decision. The pedagogical implications of the case method approach in Korean law-related social studies methods is to convert content-centered approach into instructional method-centered approach.
