아동학대 사망 사건에서 살인죄 적용에 관한 소고- 울산 계모 아동학대 살해 사건을 중심으로 -

아동학대 사망 사건에 대하여 사법기관은 그동안 관행적으로 ‘상해치사죄’ 등을 적용하여 왔으나, 최근 부산고등법원에서 ‘울산 계모 아동학대 살해 사건’에 대하여 ‘살인죄’를 선고하였다. 이 판결은 우리 사회 아동학대 범죄의 새로운 기준과 이정표를 세운 것으로 평가되고 있다. 아동학대 사망 사건은 성인간 사망 사건과 달리 가족 내에서 은밀히 이루어지고, 가해자와 피해아동의 신체적 차이, 학대의 상습성, 위계적 권력관계 등 특수성을 고려하여 법원이 사실을 인정할 때 피고인의 진술에 대한 다른 객관적 증거 및 일반적 행동 법칙에 따라 엄격한 신빙성의 판단이 이루어져야 하고, 살인의 미필적 고의의 인정 여부에 대해서도 지속적인 아동에 대한 학대로 인하여 범행에 취약해진 피해아동에게 계속하여 폭력을 행사한 경우 피해아동이 사망할 수 있다는 인식이 있다고 보아야 할 것이며, 신체 조건이 월등한 성인의 주먹과 발은 피해아동에게는 흉기나 마찬가지라는 점 등을 고려하여 살인죄 적용을 적극적으로 고려해야 한다. 영국·독일·미국 등 주요 선진국의 경우에도 흉기 등의 사용이 없는 아동학대 사망 사건에 대하여 살인죄를 인정하고, 예외 없이 법정 최고형을 포함한 중형을 선고하고 있다. 또한 연이은 아동학대 사망 사건을 계기로 아동학대 범죄는 엄벌하라는 국민적 공감대가 형성되어 「아동학대범죄의 처벌 등에 관한 특례법」이 제정된 점 등을 고려하면 그 형량도 대폭 상향되어야 한다. The judicial authority has conventionally applied ‘accidental mortality’ to the death cases from child abuse, but recently Busan High Court convicted a stepmother in Ulsan Metropolitan City, Korea, of ‘homicide’ about a murder case from child abuse. This ruling is evaluated to set up a new standard and signpost in our society about the offence of child abuse. Unlike murder cases between adults, considering that death cases from chid abuse happen secretly in the family, and considering its distinct characteristics such as physical differences between victims, recidivism of abuse, hierarchical power relation, when recognizing this fact, the court should impose a strict judgement of credibility according to other objective evidences of the defendant’s deposition and general behavior law; and also about whether the willful negligence of murder should be recognized or not, the court has to see there is recognition that when continuous violence was used to a child who became vulnerable to crime due to continuous child abuse, the victim can be dead, so the court has to positively consider to apply homicide, considering that fists and feet of adults who have superior physical conditions to children are the same as the deadly weapon to the victims. Major advanced nations, including Britain, Germany and USA, also recognize death cases from child abuse without the use of deadly weapons as homicide and sentence to a severe punishment, including the maximum penalty allowable by law, without exception. In addition, given that a national bond of sympathy to punish severely child abuse developed, following series of death cases from child abuse, and “Special Act for Punishment of Child Abuse” was enacted, the sentence for it has to be drastically increased.
