        양립가능성 규정의 적용 범위에 대한 소고 - 다른 개인정보보호 규정과의 충돌 문제를 중심으로 -

        2020년 도입된 양립가능성 규정은 당초 동의 받은 목적과 합리적 관련성이 있으며, 예측가능성, 정보주체에 미치는 영향, 안전장치를 고려하여 정보주체의 동의없이 이용할 수 있도록 하였다. 개인정보의 이용을 활성화하기 위해 도입되었지만, 양립가능성 규정은 동의주의에 기반한 개인정보보호 규정들과 충돌하고 있다. 예를 들어 민감정보 이용과 마케팅 목적 개인정보 이용시 별도 동의를 의무화한 규정들은 양립가능성 규정과 충돌한다. 그런데 양립가능성 규정은 정보주체의 사생활 보호를 위해 다양한 요소들을 고려할 수 있도록 하고 있으며, 필요할 경우 추가 안전장치도 의무화하고 있다. 따라서 규정의 충돌이 있을 경우 양립가능성 규정의 무조건적인 배제 또는 적용을 택하기 보다는, 충돌 규정의 목적과 양립가능성 규정의 요건을 고려하여 판단해야 할 것이다. 이러한 이익형량을 한다면 따라서 별도 동의가 필요한 마케팅 목적용 개인정보는 당초에 별도의 동의가 있는 경우에 한하여 합리적 관련성이 있는 경우 동의없이 이용할 수 있을 것이며, 민감정보도 양립가능성 규정의 요건을 충족하면 동의 없이 이용할 수 있을 것이다. 또한 영업양도와 합병 시에도 양립가능성 규정이 적용될 수 있을 것이다. 반면 정보주체의 동의없이 수집되는 CCTV 영상 정보와 정보주체가 개인정보 파기를 요구한 경우에는 정보주체의 자기결정권에 따라 동의없이 이용할 수 없을 것이다. The compatibility rule introduced by the amendment of the Personal Information Protection Act in 2020 allows the use of personal information without additional consent when the purposes were reasonably related to original purpose. The purpose of compatibility rule is the promotion of the flexible use of personal information by easing the strict consent principle. However, in spite of compatibility rule, many personal information protection regulations based on strict consent principle still exist and conflict with the compatibility rule. In those cases, it is unclear whether the compatibility rule may apply. For example, the compatibility rule conflict with provisions requiring separate consent for the use of sensitive information, marketing purposes, and CCTV which requires statutory basis. However, the compatibility rule allows various factors to be considered for the protection of the privacy of the data subject, and additional safety devices are also obligated if necessary. Therefore, when there is a conflict of regulations, both of the purpose of the conflicting regulation and the requirements of the compatibility regulation should be considered rather than unconditionally exclusion or application of the compatibility rule. On the other hand, CCTV video information collected without the consent of the consumer t and data which consumers demand the destruction of personal information, the compatibility rule may not applied according to the consumer right on the self determination of personal information.

      • 영양각산(羚羊角散)이 진경(鎭痙), 해열(解熱), 진통(鎭痛), 진정(鎭靜) 및 GABAergic system에 미치는 영향

        This study has been carried out to investigate the effects of Youngyanggaksan (YGS) extract on the anticonvulsive, antipyretic, anlgesic, sedative and GABAergic system of experimental animals. The results of this study were as follows : 1. YGS extract prolonged significantly the beginning time to convulsion and time to death induced by strychnine. 2. YGS extract prolonged significantly the time to death induced by electrical shock of ECT unit (3sec, 200F, 25mA). 3. On the experiment of hypothermic effects of YGS extract on the rectal temperature of rats, YGS extract decreased significantly the rectal temperature of rats. 4. On the experiment of antipyretic effects of YGS extract on the febrile induced by the subcutaneous injection of $150{\mu}g/kg$ endotoxin in rats, YGS extract decreased significantly the rectal temperature of rats. 5. On the experiment of analgesic effects of YGS extract on the writhing syndrome induced by intraperitoneal injection 0.7% acetic acid 1ml/100g in rats, the writhing syndrome was reduced significantly by administration of YGS extract. 6. On the experiment of sedative effects of YGS extract on spontaneous motor activity measured by wheel cage method in mice, the spontaneous motor activity was reduced significantly by administration of YGS extract. 7. On the experiment of effects of YGS extract on the activity of GABA-transaminase(GABA-T) in rat brains after 21 days of oral administration of YGS extract, the activity of GABA-T was reduced significantly by administration of YGS extract. 8. On the experiment of effects of YGS extract on the activity concentration of GABA in rat brains after 21 days of oral administration of YGS extract the activity concentration of GABA was reduced significantly by administration of YGS extract. 9. On the experiment of effects of YGS extract on the activity of GAD in rat brains after 21 days of oral adminstration of YGS extract, the activity of GAD was reduced significantly by administration of YGS extract. According to the those results, Youngyanggaksan extract reveals the effects on the anticonvulsive, antipyretic, anlgesic, sedative and GABAergic system.

      • 丹參飮이 實驗動物의 心血管係에 미치는 影響

        The present experiment was desinged to investigate the effects of Dansamyeum water extracts on the Cardivascular System in the Experimental Animals. Thus, the changes of blood pressure and heart rate were measured after oral administration. Measurments of Mortality rate were observed for measuring the effects of Dansamyeum water extract. Dansamyeum water extracts against pulmonary thromboembolism induced by collagen the mixture 90.1㎖/10g, 2㎖/㎏ B.W) plus serotonin(5㎎/㎏ B.W) in mouse. The effect of Dansamyeum water extract was examined by observing the change of collagen-induced platelet aggregation coagulation activity, ex vivo and in vitro fibrinolytic activity of euglobulin fraction in rats. The results were summarized as followings. 1. Dansamyeum dropped the blood pressure in spontaneous hypertensive rat. 2. The drug increased the auricular blood flow in rabbit. 3. The drug relaxed the artery contraction by pretreated norepinephrine in rat. 4. The drug inhibited the death rate of mouse which were led to thromboembolism by serotonin and collagen. 5. The drug inhibited the platelet aggregation in rat. 6. The drug prolonged the prothrombin time and activated partial thromboplastin time on the test of plasma coagulation factor activity in rat, but was not valuable. 7. The drug increased the antithrombin activity in rat and the fibrinogen lyses time was reduced and lyses area was increased. 8. Dansamyeum reduced fibrinogen lyses time of rat in vitro assay. According to the above mentioned results, Dansamyium increased the blood flow and dropped the blood pressure by the dilation of blood vessel. And the drug presented the antithrombin acivity, inhibited the platelet aggregation.
