Coated Conductor의 특성 및 미세조직에 미치는 고온열처리 영향

고온초전도 CC를 다른 산소 분압에서 Ag과 YBCO의 녹는점 보다 낮은 온도에서 열처리시 CC의 특성에 미치는 영향을 실험하였다. 전류의 수송능력과 미세구조는 보호층인 Ag의 존재여부에 다양하게 영향을 미친다. Ag를 제거한 CC를 $850^{\circ}C$의 산소 분위기에서 2시간 동안 열처리 한 시편의 경우 CC의 임계전류의 특성에 영향을 미치지 않았다. 그러나 Ag를 제거하지 않은 CC를 $800^{\circ}C$의 산소 분위기에서 2시간 동안 열처리한 시편의 경우 임계전류가 140 A에서 8 A로 떨어지는 결과를 보였다. 또한, Ag을 제거하지 않은 CC를 1000 ppm 산소 분위기의 $800^{\circ}C$에서 2시간 동안 열처리한 시편의 경우 임계전류 값이 원래 $I_c$ 값의 $70{\sim}80%$의 임계전류 값이 나타났다. SEM 이미지와 XRD 회절 분석 결과 Ni과 Cr 원자들이 표면으로 확산되어 CC의 전류수송 특성에 영향을 미친다. HTS coated conductor was heat treated at high temperatures below the melting points of silver and YBCO at different oxygen partial pressures. Current carrying capacity and microstructure were varied depending on the presence of silver protection layer. Critical current of coated conductor without silver protection layer was not changed when heat treatment was performed at $850^{\circ}C$ for 2 hr in an oxygen atmosphere. However, coated conductor with silver protection layer revealed abrupt drop of $I_c$ from 140A to 8A when heat treatment was performed at $800^{\circ}C$ for 2 hr in an oxygen atmosphere. Coated conductor with silver protection layer retained $70{\sim}80$ percent of its original $I_c$ when heat treatment was performed at $800^{\circ}C$ for 2 hr in an argon atmosphere containing 1000ppm oxygen. SEM and XRD observations showed the presence of interaction between YBCO and silver depending on the atmosphere of heat treatment. The reaction between YBCO superconductor and silver was accelerated at high oxygen partial pressure and resulted in the change in microstructure and decrease of critical current density even by the heat treatment performed at temperature much lower than the melting points of silver and YBCO.

지휘관 및 상급자 책임, 사법방해죄에 대한 ICC 확정판결이 국내 법원에 미치는 효력 : 「국제형사재판소 관할 범죄의 처벌 등에 관한 법률」 제7조 적용여부를 중심으로

로마규정의 이행법률인 「국제형사재판소 관할 범죄의 처벌 등에 관한 법률」 제7조는 핵심범죄에 대한 ICC의 확정판결이 있는 경우 국내 법원이 면소 판결을 선고하도록 정하였다. 그러나 로마규정 제28조의 지휘관 및 상급자 책임에 상응하는 위법률 제5, 15조와 로마규정 제70조의 사법방해죄에 상응하는 위 법률 제16조의 범죄는 위 제7조의 적용대상에서 누락되어 있다. 따라서 로마규정 제28조, 제70조에 대한 ICC의 확정판결이 있는 경우에는 국내법원이 실체 판단에 나아가야 하는지 문제된다. 지휘관 및 상급자 책임에 관한 제5조는 그 입법형식에 비추어 하급자의 핵심범죄에 대한 공범규정임이 비교적 명백하다. 제15조의 경우 독자적인 형이 규정되어 있고 과실방조는 성립할 수 없다는 것이 국내의 통설적 견해이나, 로마규정과 독일 국제범죄법과의 비교 및 대조를 통해 위 조항을 분석하여 보면 제15조 역시 제5조와 동일하게 이를 공범규정으로 파악하는 것이 타당하다. 이를 독자적인 범죄로 본다면 법정형이나 인과관계의 문제가 설명되지 않고, 구성요건 해당성 판단에 있어 객관적 처벌조건을 고려하는 모순이 발생한다. 결과적으로 제7조의 면소규정은 핵심범죄의 공범규정인 제5, 15조에도 적용된다고 보아야 한다. 한편, 제16조의 사법방해죄에 대하여는 제7조가 적용된다고 할 수 없으나, 로마규정의 취지와 상호주의와 관련한 국내 입법례에 비추어 제7조를 유추적용 하는 것이 바람직하다고 보인다. According to Article 7 of the 『Act on the Punishment, etc. of Crimes within the Jurisdiction of the International Criminal Court』(hereinafter, “Korean ICC Act”), which is the implementing legislation of Rome Statute in Korea, ‘any prosecuted case involving the crime of genocide, etc. for which the ICC has already made final judgment, shall be declared dismissed by judgment’. However, excluded from the scope of Article 7 of the Korean ICC Act are Article 5, 15 of Korean ICC Act corresponding to Article 28 of the Rome Statute, and Article 16 of Korean ICC Act corresponding to Article 70 of the Rome Statute. Article 5 is obviously an accomplice provision, in the light of the form of legislation. With regard to Article 15, in spite of the common view that aiding and abetting by negligence is not punishable, it should be interpreted as an accomplice provision as well, which can be deduced from the analysis with the Rome Statute and the German International Criminal Code. If those Articles are viewed as independent crime provisions, several matters, e.g. difference between degrees of punishment or causality, cannot be explained. Therefore, Article 7 Shall be considered to be applicable to Article 5, 15, which are accomplice provisions of core crimes. It is hard to say that Article 7 applies directly to Article 16. Nevertheless, given the purpose of the Rome Statute and principle of reciprocity, it is desirable to extend the scope of Article 7 by analogy.
