우리나라 서해에서 활동 중인 중국 해상민병대의 불법침략 조업 실태와 대책에 관한 연구

중국은 어민으로 위장한 75만명의 해상민병대를 운용하고 있다. 이들은 우리나라 이어도와 격렬비열도 및 서해 5도가 위치한 북방한계선 NLL 해역에서 마구잡이 불법 침략조업을 주도하고 떼로 몰려다니면서 우리 해양경찰의 단속에 폭력으로 대항하고 있다. 그러나 우리정부의 적절하고 마땅한 조치는 별로 보이지 않는다. 지금까지 중국어선 불법조업에 관한 논문은 주로 해양경찰청 경찰백서와 우리나라 단속법규 및 단속방법, 해양경찰의 열악한 환경 등에 기초한 자료에 따라 문제점을 논의하는데 그쳐, 중국 불법침략조업의 근본인 해상민병대의 특징과 해상민병대의 불법침략조업 수법을 분석하는데 미흡하며 중국 해상민병대의 불법침략조업에 대한 효과적인 대책을 제시하지 못했다. 따라서 이번 연구는 우리 서해에서 불법침략조업을 주도하는 중국 해상민병대의 개념과 운영근거, 현황을 먼저 살펴보고 중국 해상민병대의 특징과 불법침략조업의 수법을 분석하여 중국 해상민병대의 불법침략조업에 대한 효과적인 대책을 제시하였다. 미국과 중국 간의 패권경쟁과 역내 국가 간 안보갈등이 동시에 나타나는 회색지대 해양분쟁의 무대인 우리나라의 서해에서 중국의 해상전략과 실행수단인 해상민병대의 활용과 그 효과에 대하여 살펴보고 중국 해상민병대의 다양한 불법침략조업 전술과 전략을 분석하는 것으로서 중국의 서해에 대한 해상전략을 이해하여 우리바다인 서해와 이어도 및 격렬비열도와 서해 5도가 위치한 NNL 해역을 수호할 수 있는 대응방법을 찾을 수 있을 뿐만 아니라 중국 해상민병대 불법침략조업의 근본적인 해결방안에 도움을 줄 것으로 생각한다. China operates 750,000 maritime militia troops disguised as fisherman. They are fighting against the Korean maritime police with violence by leading random illegal fishing and flocking in groups in the NLL waters of the Northern Limit Line, where Socotra Rock, the violent Gyeongnyeolbi-yeoldo, and the West Sea 5 are located. However, there are few appropriate and appropriate measures by our government. So far, papers on illegal Chinese ships have only discussed problems mainly based on the police white paper of the Maritime Police Agency, Korean crackdown laws and crackdown methods, and poor environment of the maritime police. It is insufficient to analyze the characteristics of maritime militia, which is the basis of illegal violence fishing in China, and methods of illegal violence fishing using maritime militia, and failed to present effective measures for illegal violence fishing using Chinese maritime militia. In addition, among the existing studies, marine disputes and gray areas in the South China Sea and case studies of Chinese maritime militia civilian forces were the only. Therefore, this study first examined the concept, operation basis, and current status of Chinese maritime militia leading illegal violence fishing operations in the West Sea. By analyzing the characteristics of Chinese maritime militia and methods of illegal violence fishing, effective measures for illegal violence fishing using Chinese maritime militia civilian forces were presented. The use and effect of China‘s maritime strategy and implementation means of maritime militia civilian forces in Korea‘s West Sea, a stage of maritime militia disputes between China and the United States and security conflicts between regional countries, were examined. Understand China‘s maritime militia strategy for the West Sea by analyzing the tactics and strategies of various illegal violence fishing operations using the Chinese Maritime militia Civil Corps. Not only can we find a countermeasure to protect the NNL waters where the West Sea Located, Socotra Rock and Gyeongnyeolbi-yeoldo but we also think it will help fundamental solutions to illegal violence fishing by Chinese maritime militia.
