대화하는 「법」과 「교육」 ― 일본에서의 법교육의 필요성과 담당자 문제 ―

이 연구는 법교육이 필요한 것인가에 대한 물음에서 출발하여 법교육이 사회적 요구에 충분히 대응하고 있는지, 법 전문가와 교육영역의 원활한 커뮤니케이션 하에서 그 위치를 설정하고 있는지를 파악하는 목적을 가지고 있다. 이를 위해 일본에서 행정이 법교육 활동에 대하여 어떤 입장을 취하고 있는지에 관한 조사를 중심으로 현황을 파악하고, 몇 가지의 쟁점에 대하여 같은 시기에 실시된 법 전문가에 대한 조사 및 전국의 고등학교에 대하여 실시한 조사와 비교 검토를 통해 그 실태를 파악해보고자 한다. 분석 결과는 다음과 같다. 첫 번째로, 법 전문가와 교육현장, 교육행정을 전체적으로 조망할 수 있게 되었다는 점을 들 수 있다. 두 번째로, 법교육에 있어서의 불신, 의문 등의 일부 문제점들이 데이터를 통하여 명확해졌다는 점이다. 세 번째로, 법교육에 초점을 맞추어 이것이 기존의 교육이나 법 전문가의 모습에 어떤 영향을 미칠 수 있을 것인지에 대한 단서를 찾을 수 있었다는 점을 지적할 수 있다. 법교육 영역은 이러한 실태와 문제를 넘어서, 법교육 활동을 단순한 하나의 교육활동이 아닌 법의식과 법문화를 아우르는 사회개혁운동 그 자체로서 설정해야 할 것이다. The purpose of this study is to determine whether law education is sufficiently responding to social needs and whether it is positioned in the smooth communication of legal experts and education areas. In order to do this, This study investigated the status of the administration in Japan, focusing on the question of what kind of position the government is taking in relation to the law education activities, and conducted a survey on legal experts conducted at the same time and some high schools nationwide I will try to understand the situation through investigation and comparative review. The results of the analysis are as follows. First, it can be seen as a whole view of law experts, education field, and education administration. Second, some problems such as mistrust and doubt in law-related education have become clear through data. Third, it can be pointed out that the focus was on law-related education, which could lead to clues as to how this might affect the appearance of existing education or legal experts. Beyond these realities and problems, the law education field should be set up as a social reform movement itself that encompasses law-related education and legal culture instead of just one education activity.
