Economic development necessarily requires both competitive markets and a certain level of governmental regulation. The problem is how properly to balance the two extremes, given the prevailing conditions in the particular marketplace. Without exception, any form of regulation has been the subject of constant public debate with respect to its desirability and efficiency throughout the world where trade barriers are being gotten rid of in a new world order under the WTO system. The focus of the Dissertation is on how to approach realization of a free and competitive market in the information and telecommunications industry with several peculiarities worthy of special treatment, which other traditional industries usually do not have. The main issue addressed by the Dissertation is how to decide on the degree and form of governmental regulation for the well-functioning of a free market in the information and telecommunications industry. In other words, is deregulation a proper course of action, and if so, to what extent? Or is new regulation or re-regulation necessary and in what form? The Dissertation aims to address the bases, objectives, means and contents of governmental regulation, and regulatory agencies and statutes, for creating a regulatory environment in which free and fair competition in the information and telecommunications industry can be achieved.
