중국은 근래에 엄중한 학교폭력 사건이 자주 발생하고 있으며 청소년 심신의 건전에 심각한 영향을 주고 있다. 그 원인 분석을 해 보면 학교폭력 관련 법률의 문제, 법제 교육의 미비, 책임의 주체에 대한 처벌 등 문제들이 있다. 중국의 실정은 학교폭력 등에 대한 체계적 연구가 비교적 늦게 시작되었고 관련 이론과 실천 경험이 아직 미숙한 편이다. 서구의 선진국과 비교해 보면 중국과 일본은 문화 배경과 교육 모델에 많은 유사성이 존재하고 있다. 하지만 일본은 이미 '학교폭력방지 대책 추진법'을 근간으로 한 입법을 통하여 다원화 된 주체 협력의 방지체계를 구축하여, 예전에 엄중하였던 학교폭력의 현상을 효과적으로 대처하고 있다. 본문은 우선 현시점의 중국 학교폭력의 상황을 살펴보고, 일본의 선진경험을 적절히 참작하여 중국에 존재하고 있는 문제점을 분석 및 반성하여 종국적으로 학교폭력의 예방시스템 구축에 도움되는 제안을 하고자 한다. In recent years, the continuous school-bullying has seriously affected the physical and mental health of teenagers. At the same time, it also reflects some problems such as lack of relevant laws, inadequate legal education, and ineffective accountability of responsible subjects. In China, there are not so many systematic researches on school-bullying. The relevant theories and practical experience are till not enough. Compared with developed countries in the West, China and Japan have many similarities in cultural and educational backgrounds. However, Japan has effectively managed the severe phenomenon of school-bullying under the establishment of multi-subject cooperation prevention system, which is centered on the Law on Promotion of Countermeasures against School Bullying(Anti-School Bullying Law) and is led by national legislation. This paper points out current defects and inadequacy of school-bullying legislation and builds a practical and feasible school-bullying prevention system that suits the fundamental realities of China according to the advanced experience of Japan in legislation.
