다원주의 사회에서 사회과는 무엇을 가르쳐야 하는가?:쟁점 중심 사회과 교육과정 이론의 전형으로서 법리적 교육과정 이론 논고

이 글은 Donald Oliver, James Shaver, 그리고 Fred Newmann이 출간한 법리적 교육과정에 관한 연구 문헌들을 근거로 하여 법리적 교육과정 이론에 관하여 고찰한다. 이 글의 목적은 법리적 교육과정의 토대가 되는 주요한 논리(이론)적 근거를 상세히 검토함으로서 법리적 교육과정 이론을 보다 깊이 있게 이해하는 것이다. 법리적 교육과정 이론가들은 가치갈등이 불가피한 다원주의 사회의 본질을 고려할 때 중등학교의 사회과 교육과정에서는 공공 쟁점에 관한 합리적인 의사결정이 내용 선정의 기준이 되어야 한다고 주장한다. 법리적 교육과정 이론은 비판받아야 할 점이 있음에도 불구하고 사회과의 역사에서 대단히 중요한 의미를 지니고 있다. 왜냐하면 이것은 쟁점 중심 사회과 교육과정 이론의 전형을 보여주고 있기 때문이다. 법리적 교육과정 이론은 사회과 교육과정의 개발(내용 선정) 논리에 있어서 쟁점 중심 사회과 교육과정이 학문에 기초한 사회과 교육과정을 비롯한 여타의 사회과 교육과정과 어떻게 다른지를 명확히 보여준다. 이런 점에서, 법리적 교육과정 이론은 이에 대한 비판을 충분히 수용한다면 다원화된 민주주의 사회에 살고 있는 우리가 쟁점 중심 사회과 교육과정 이론을 구축하고자 할 때 본보기로 삼을 만하다. Based upon various research papers on the jurisprudential curriculum published by Donald Oliver, James Shaver, and Fred Newmann, this essay reviews the jurisprudential curriculum theory. The purpose of this essay is to more deeply understand the jurisprudential curriculum theory by examining in detail the rationale of the jurisprudential curriculum. Considering the pluralist nature of the American society, the jurisprudential curriculum theorists insist that a rational decision-making about public issues should be the criteria for content selection in the secondary social studies curriculum. In spite of some criticism, the jurisprudential curriculum theory has a significant meaning in the history of social studies because it is a model of issues-centered social studies curriculum theory. It clearly shows that issues-centered social studies curriculum is totally different from discipline-based social studies curriculum in the logic of content selection in social studies curriculum. This essay concludes that the jurisprudential curriculum theory is an exemplary issues-centered social studies curriculum theory to which we could refer in developing our own issues-centered social studies curriculum theory.

시장경제의 보편화를 내세우며 다양한 문화적 정체성을 고려하지 못하는 위로부터의 세계화의 부정적 측면을 수정하고자 '아래로부터의 세계화'와 '세계시민사회'의 영역이 대두되고 있다. '아래로부터의 세계화'의 맥락 속에 있는 세계시민사회는 다양한 문화적 특수성에서 출발하면서도 보편을 지향한다. 이 과정에서 다문화주의와 세계시민사회는 서로 지지하고 요청하는 관계를 띤다. 다문화주의적 시민교육은 이러한 현실을 담아내고 동시에 그에 대해 능동적으로 대응 할 수 있어야 한다. 본 논문에서는 이를 위해 '쟁점 중심 지구촌 다문화교육'을 제안하고자 한다. 이는 곧 '초국가적 쟁점'을 내용으로 '논쟁문제학습'을 방법으로 하는 것이다. 인권, 반전, 평화, 환경, 생존 등 초국가적 쟁점과 그것이 기반해 있는 다양한 문화적 배경과 원인을 다문화교육의 내용으로 도입하여 논쟁문제를 해결하는 과정과 절차에 따라 접근해 보자는 것이다. 이는 곧 다양한 문화적 배경으로부터 시작하여 초국가적 쟁점을 공적이고 보편적인 방식으로 해결하고자 하는 세계시민사회의 기획과도 잘 부합한다. 'Globalization from above', giving priority to the universalization of market economy, has some negative aspects of insufficient consideration for various cultural identity. 'Global civil society', which is in the context of 'globalization from below' has been rising in order to rectify them. It seeks after universality, while it indeed starts from various cultural particularities. In this process, multiculturalism has a close relationship with global civil society, in that both of the two support and need each other. Multicultural citizenship education must meet positively these phenomena as well as contain them. 'Issue-centered global multicural education' can be proposed for this purpose in this article, which includes 'transnational issues' as contents and 'controversial issues learning' as a teaching method. It suggests that we introduce such transnational issues as human rights, anti-war, peace, environment, livinghood (etc.) and their multiple cultural backgrounds and causes, and solve them according to the procedure of controversial issues learning. This can go in harmony with the project of global civil society which, beginning with diverse cultural sources, makes efforts to settle the postnational issues in the public and universal manner.
