법적 논의와 판결의 합리성 - 대화이론과 절차보장론을 중심으로 -

이 논문의 목적은 대화적 합리성과 절차적 정당성에 대한 논의를 중심으로 판결의 합리성에 대하여 탐구하는 것이다. 현대형 소송의 증가로 활발한 법정 변론이 전개되면서 정의와 권리를 둘러싼 원리적 논의의 공적 장(forum)으로서의 재판에 대한 관심과 기대가 높아지고 있다. 이에 따라 재판의 기능이 분쟁 해결뿐만 아니라 정책형성과정으로 확대되어, 정치적·도덕적 문제가 법적 논의나 재판절차의 주제가 될 가능성이 넓어지고 있다. 또한, 판결의 기능뿐만 아니라 판결에 이르는 절차에도 그 논의가 확대되어 재판절차에서의 당사자의 참가 보장이 중요한 문제로 대두되고 있다. 이러한 현상의 영향으로 법학 방법론에서 법에 의한 정의 실현의 가능성과 한계, 즉 재판에서의 법적 논의의 합리성을 어떻게 확보하고 판결의 정당성 근거를 어디에서 구하는가가 중요한 쟁점이 되었다. 이 논문은 법학의 이러한 관심과 논의를 계기로 판결의 합리성을 보장하기 위한 법적 논의에 대해 탐구하려는 것이다. 이를 위해 법적 논의와 재판절차에서의 실천이성의 복권 가능성과 한계의 해명이라는 실천철학적 관심에서 논의의 방향을 찾고, 법적 합리성의 문제를 법적 논의의 합리성과 재판의 절차적 정당성으로 나누어 논증한다. 이를 통해 법실무와 실천철학에 공통되는 과제인 법적 합리성 혹은 정의의 실현에 기여할 수 있는 가능성을 찾으려는 것이다. The purpose of this article is to explore the rationality of the judgment, focusing on the Communicative rationality and procedural justification. As active court arguments develop in increasing modern lawsuits, interest and expectations for trials as a public forum for principle discussions surrounding justice and rights are growing. Thus, the function of the trial expanded not only to resolve disputes but also to the process of policy formation, and the possibility that legal discourse or trial procedures will be the subject of political and moral considerations is also widening. In addition, discourse have expanded on the function of judgment made by judges and procedures for reaching a decision. The issue of guaranteeing parties" participation in the trial process has come up. According to this phenomenon, the possibility and limitations of realizing justice by law in legal methodology, have become an important issue. The main problem is how to secure the rationality and where to obtain the justification, This paper examines legal discourse to ensure the rationality of judgment with this interest and discussions in law. I proved the legal rationality issue with the rationality of discourse and procedure justice of trial to the direction of the practical philosophical interest, representing the possibility of reinstatement of practical reason and explaining limitations in legal discourse and trial proceedings. Through this, I intended to find the probability of contributing to the explanation of tasks common to the philosophy of practice while focusing on the tasks facing legal practice.

상호텍스트적인(intertextual) 신학의 가능성 탐구53) : 텍스트내적인(intratextual) 후기자유주의 신학을 넘어서

본 논문은 후기자유주의 신학자들인 조지 린드벡(George Lindbeck)과 스텐리 하우어워스(Stanley Hauerwas)의 신학이 보여주는 탈토대주의적인 성격이 고백주의와 분파주의를 불러 온다고 비판하고, 그러한 나르시즘적인 폐쇄성을 극복하기 위해 대화적 합리성이 반드시 필요하다고 주장한다. 즉, 지양 없는 중재, 흡수 없는 통합이라는 대화적 합리성을 통해 텍스트내적인 신학(intratextual theology)이 상호텍스트적인 신학(intertextual theology)으로 변화되어야 할 것을 요청한다. 이런 의도에서 본 논문은 먼저 린드벡과 하우어워스의 신학이 가지는 반토대주의적인 성격을 밝힌 후, 상호텍스트적인 관점에서 그 두 신학이 가진 고백주의와 분파주의를 비판할 것이다. 그 후 후기자유주의 신학자라고 보통 평가되지만 ‘은밀하게’ 상호텍스트적인 신학을 보여주는 한스 프라이(Hans Frei)의 서사신학(narrative theology)을 통해 후기 텍스트내적인 후기자유주의 신학 내부에서 상호텍스트적인 신학의 가능성을 탐색할 것이다. According to foundationalism, there is an indubitably self-justified belief, and knowledge is constructed inferentially from such an epistemological foundation. Karl Barth and Alvin Plantinga are representative for such a foundationalism in the theological field. But, such a foundationalism is not able to be justified epistemologically, because knowledge is fundamentally theory-laden. It cannot exist without a specific web of belief. On this point, we need to pay attention to antifoundational theologians such as George Lindbeck and Stanley Hauerwas. But, we should go beyond such a postliberal theology through the intertextual rationality which Hans Frei shows in his narrative theology, because it is liable to a sectarianism.
