본 연구는 무권대리인의 촉탁에 따른 집행증서의 효력을 살펴보고, 향후 체계적 논의 방향을 제시하는데 그 목적이 있다. 이를 위해 기존의 통설과 판례에 대한 문제점을 중점적으로 살펴보았다. 이 연구의 결과는 다음과 같다. 첫째, 공증인의 집행증서 작성행위는 당사자의 공증촉탁과 공증인의 행위가 결합되어 있고, 이는 제소전 화해와 유사한 성질을 가지고 있다. 둘째, 집행수락의 의사표시는 채무자의 공증인에 대한 단독적 의사표시가 아니라, 당사자의 공증 촉탁행위에 내포되어 있는 의사표시이며, 공증인은 단지 이를 확인하는 것에 불과하다. 셋째, 공증제도가 갖는 공익적 성격에 비추어, 집행증서의 성립은 엄격한 요건하에 인정되어야 한다. 이러한 연구결과를 바탕으로 추후 집행증서의 효력 문제에 대한 논의가 보다 체계적이고 심도있게 논의되기를 기대한다. The purpose of this study is to examine the effect of the execution certificate according to the entrustment of an unauthorized agency, and to suggest a systematic discussion direction in the future. To do this, this study focused on the problems related to the popular opinion and supreme court precedents. The results of this study are as follows. First, the notary’s act of writing an execution certificate is a combination of the party’s request for notarization and the act of a notary, which has similar properties to reconciliation before sue. The expression of acceptance of execution is not the sole expression of will of the debtor's intention to the notary, it is an expression of intention that is implied in the act of entrusting a party to notarize, notary public is just confirming this. Third, in view of the public interest nature of the notary system, the establishment of an execution certificate must be recognized under strict requirements. Based on these research results, in the future hope that discussions on the validity of the execution certificate will be discussed more systematically and in depth.

이 논문은 양자간 부동산 명의신탁에 있어서 책임재산의 귀속 문제를 다루고 있다. 이를 위해 관련되는 대법원 판례와 학설을 검토하고, 그에 따른 새로운 법리를 제시하는데 목적을 두었다. 연구 결과 다음과 같은 결론에 이르게 되었다. 첫째 명의신탁자와 명의수탁자 중 누구의 책임재산인지를 파악하는 함에 있어서는 명의신탁의 내부적 소유관계에서가 아니라 외부적 소유관계에 따라 파악하여야 한다. 따라서 명의수탁자의 책임재산이라고 하여야 하고, 이는 모든 유형의 명의신탁에 적용될 수 있다. 둘째 명의신탁 유형에 따라 책임재산의 귀속관계를 다르게 파악한다면, 신탁자로 하여금 채권자 취소권을 회피할 수 있는 명의신탁을 하도록 조장함으로서 결과적으로 사법부와 법률에 대한 국민의 신뢰를 저하시킬 것이다. This paper examine with the issue of imputation of liability property in bilateral real property registry title trust. The purpose of this paper is to review the Supreme Court precedents and theories and to suggest new legal principles. The result of this study is as follows. First, the identification of liability property of title truster or trustee should be based on the external relation of ownership, not the internal relation of ownership of the trust. Second, if the trust relationship is identified differently according to the type of title trust, it will encourage the truster to take the type of avoidance of obligee’s right of revocation, as a result, it will lower public confidence in the judiciary and the law.

기존 터널 보강공법인 강관보강그라우팅 공법은 천공된 홀 내부에 존재하는 잔류공기로 인해 그라우트재가 밀실하게 충전되지 못해 보강이 불량하게 되는 경우가 있다. 이를 개선하기 위해 개발된 TMG 공법은 Air discharge tube 를 이용하여 잔류공기를 제거하고 그라우트재의 밀실충전이 가능한 공법이다. 본 공법의 현장실험을 통해 그라우트 재료가 천공홀 주변 미세공극까지 침투되어 주변지반을 균질하게 고결시킬 수 있음을 확인하였다. 따라서 TMG 공법은 터널 시공시 안정성 확보에 유리하고 환경 친화적인 차수 및 지반보강의 목적으로 폭넓게 적용될 수 있을 것으로 기대된다. The small and large caliber steel pipe reinforcement grouting of tunnel top cannot densely fill grout materials into the boring hall because of the residual air inside boring hall. On the other hand, TMG method eliminates residual air by using an air discharge tube, and enables to densely fill the grouting material in the boring hall. Field test showed that this method penetrated the grout materials into the micropore around the boring hall, and led to the uniform ground improvement. Therefore, this method hopes to be applied to the tunnel for the purpose of eco-friendly waterproof and ground improvement.
