유엔여성차별철폐협약(CEDAW) 이후 미국남녀평등헌법수정안(ERA)의 비준동향과 시사점

This study is about the meaning and impact of Equal Rights Amendments of USA that is rising again as a critical issue in United States of America since the rectification of the Convention on the Elimination of All Forms of Discrimination Against Women(CEADW). Equal Rights Amendments also has been suggested as an implementation policy for the goal of CEADW. Above all, this research is essential to current Korean society because one of the strong motives to boost up the issue of Equal Rights Amendments was ‘Me Too’ movement that recently struck the whole American society. Therefore, this study is focused on the impact and meaning of ERA from the perspective to actualize the goal of CEADW. All in all, this analysis is aimed at finding out the desirable law and policy for the prohibition of all forms of sexual discrimination in Korean society. 본 글은 최근에 다시 이루어지고 있는 미국남녀평등헌법수정안에 대한 각주의 비준승인과 관련된 국제법상 법적분석과 그 정책적 시사점에 관한 것이다. 국제법상 여성인권에 대한 가장 대대적인 근거가 마련된 시점은 바로 유엔여성차별철폐협약의 체결이라고 볼 수 있다. 유엔여성차별협약의 체결은 비록 그 실질적인 이행에 있어서 많은 문제점을 가지고 있지만 전 세계적으로 상당한 지역적 여성인권협약들이 체결되고 이행되게 한 가장 중심적인 근거이고 또 수단이자 목적이 되고 있다. 그만큼 미국의 남녀평등헌법수정안 또한 유엔여성차별철폐협약의 간접적인 영향을 받았고 무엇보다 최근 미국에서 일어난 ‘미투’사건의 운동이 그 저변 추진력이 되었다는 점에서 우리나라에도 시사하는 의미는 크다. 따라서 이 글은 유엔여성차별철폐협약이 체결된 이후 미국남녀평등헌법수정안의 역할과 효과에 대한 분석을 한다. 그리고 이러한 분석과 검토를 통해서 궁극적으로 한국의 여성인권보호 및 남녀차별금지관련 법안에 주는 정책적 시사점을 도출하려 한다. 또한 이러한 시사점은 특별히 국제법상 다자적 인권협약의 특성에 부합하고 일조하는 한국의 남녀차별금지법이라는 지역적 여성인권보호법을 제정을 위한 검토이다.

남녀 대학생 성피해 경험과 성인지 및 정신건강과의 관계

본 연구는 대학생을 중심으로 남녀 성별에 따라 성피해 경험과 성인지(性認知)및 정신건강 간에 어떠한 관계가 있는지를 알아봄으로써 성피해 후유증의 올바른 이해를 위한 기초 자료를 제공하고자 한다. 본 연구에서는 남녀대학생 496명을 대상으로 원하지 않는 성피해 경험,성인지,정신건강에 대한 검사를 실시하였다. 연구의 결과를 요약하면 다음과 같다. 첫째,먼저 남녀 대학생을 대상으로 성피해 경험 유무를 분석한 결과,성 피해자들은 156명 으로 전체 31.5%를 차지하였다. 여자는 290명 중 99명인 34.1%,남자는 206명 중 54명인 27.7%가 성피해 경험이 있다고 보고했으며 남녀 비율에서 유의미한 차이를 보이지 않았다. 둘째 남녀 대학생의 성피해 경험에 따른 성인지와 정신건강과의 관계를 파악하기 위해 상관분석을 실시하였다. 그 결과 성피해 경험이 있는 남학생과 여학생 모두 부정적인 성적인지와 정신건강 9개 하위요인 모두에서 정적 상관이 있는 것으로 나타났다 국내에서 성피해 관련 연구가 점점 증가하고는 있지만,성적영역(性)과 관련된 연구는 거의 이루어지지 않고 있으며,남녀 대학생 집단을 대상으로 한 연구 또한 부족한 실정이다. 따라서 본 연구에서는 일반 남녀 대학생집단을 대상으로 그들의 성피해 경험 여부와 성인지(sexual cognition)및 정신건강과의 관련성을 살펴보았다. 특히 성피해와 정신건강의 관련성이 있다 는 연구들을 토대로 이를 확장하여 성피해자의 성인지와 정신건강과의 관계를 남녀를 중심으로 살펴보았다. This study aims to provide the data for correct understanding of psychological side effect on sexually assaulted group by examining the relationship of sexual abuse history,sexual cognition and mental health on the normal university student group. For this study,a survey of sexual abuse history,sexual cognition and mental health,which was designed for 496 university male and female students,was conducted. The brief summary of the survey is as follows. First,sexually abused victims were 156 which was 32.1 % of overall number,female victims who had experience of sexual assault were 99(34.1 %),male victims were 54(27.7%). There is no odds between male and female. Second,In male and female sexual assaulted group,negative sexual cognitions are related with mental heath. This result suggests that,on therapeutic intervention for positive daily life and psychological recovery of sexual survivor,understanding their sexual domain and counseling considered sex difference are necessary,that counseling would be effective.

미연방헌법상 조약권한과 주권의 균형적 조율방안에 관한 연구

This era is the very time that all the nations need to cooperate through the international rule of law since scientific technology and the system of international economic integration policy have made all the nations as very close neighbors to one another. Therefore, all the nations and international organizations need to take a step further to carry out their foreign policies and instruments in order to establish peace and to improve the welfare of entire human race with overcoming the old-fashioned way of thinking, ‘Isolated Nationalism’. However, it is still very difficult legal problem to decide how much power the national sovereignty needs to confer her powers to treaty powers specially in relation with civil liberty with a view to establish the international rule of law. Thus, this study first of all researches on the provisions and historical backgrounds of treaty powers specified on American Constitutions, and then studies on the relate important cases. Lastly, this study brings on much debate and philosophical discussions on finding out the right position of check and balance among the tree factors of ‘Treaty Power as the same position with ‘Federal Sovereignty’, ‘State Sovereignty’ and ‘Civil liberty’ in order to contribute to building a trustworthy international society rooted on international rule of law. 21세기 현재 국제사회는 과학과 기술의 발전과 상호의존적 국제경제통합 정책의 확산으로 더욱 더 연결되고 있다. 따라서 현재는 구시대적인 고립된 민족주의를 넘어 서서 인류전체의 복지와 평화를 수호하는 역할을 해낼 수 있는 국제기구 및 국가들의 대외정책들의 필요성이 필수불가결한 시점이라고 판단한다. 하지만 국제사회를 건설해 나가는 수단이 되는 법치주의 즉 국제법은 한 국가 주권과 한 시민의 자유권과의 관계에서 어느 정도 구속적이고 지켜져야 하는지는 끊임없이 논의가 필요한 어려운 문제이다. 본 논문에서는 첫째 미연방헌법상 조약의 권한이 헌법적으로 정립된 역사적 배경과 관련 주요한 조항들에 관한 분석을 한다. 둘째 미연방헌법상 조약권한과 주권의 균형적 조율과 관련된 전통적 판례들을 분석한다. 특별히 이러한 분석을 첫째 조약과 이와 한 입장으로의 미연방정부의 주권(Federal Sovereignty), 둘째 미연방정부의 주권과 대립하는 50개 주정부의 주권(State Sovereignty), 셋째 주 안에서 거주하는 한 개인의 자유권(Civil Liberty)과의 관계를 중심으로 진행한다. 마지막으로 이러한 삼각형적인 관계를 중심으로 미연방헌법상 조약권한과 주권의 균형적 조율방안을 모색하기 위한 최신 판례분석 후, 관련 이론을 통해서 검토한 후 개선방안을 도출해 보고자 한다.
