1392년 사족체제 성립 이후 남성 사족(士族)은 국가 권력을 동원해 여성의 사회적 지위를 조정하고자 하였다. 이를 위해 다양한 담론과 방법이 동원되었다. 이 논문은 그 중 일부를 다룬 것이다. 대체로 남성사족은 『소학(小學)』에 근거해 여성의 활동공간을 가정 안으로 제한하고 일체의 종교적 활동을 금지하고자 하였다. 그것은 여성의 사회적 활동을 제한하는 것이었다. 한편으로는 그것은 사족체제가 불교적ㆍ무속적(巫俗的) 의례(儀禮)에서 유교적 의례로 전환하는 과정에서 반드시 필요한 일이기도 하였다. 하지만 그 통제의 이면에는 여성의 성적 욕망을 통제하고, 여성을 남성에게 일방적으로 성적으로 종속시키고자 하는 의지가 있었던 것으로 보인다.남성사족의 욕망과 의도가 온전히 관철되기 시작한 것은 임병양란이 끝난 17세기 중반 이후부터였다. 그 전까지 남성은 여성의 집으로 ‘장가’를 갔고(婦處制), 처가에서 자식을 낳고 길렀다. 남성사족이 국가권력을 동원해 제도를 바꾸어나가는 동안, 남성과 여성은 심한 갈등을 겪었던 것은 이런 상황 때문이다. 그 갈등의 양상은 또 『실록(實錄)』을 위시한 문헌에서 충분히 확인할 수 있을 것이다. 그렇다면 무엇이 17세기 중반 이후 남성사족의 계획을 실현할 수 있게 했을까? 지금으로서는 단언할 수 없지만 결국 임진왜란과 병자호란이란 두 차례의 전쟁 때문이 아닌가 한다. 앞으로 치밀한 증거를 수집해야겠지만, 두 전쟁으로 조선전기의 노비경제가 무너지고 토지를 망실하게 된 것이 결국 여성에 대한 상속을 제한하게 된 것이 결정적 계기가 된 것이 아닌가 한다. In Joseon, so-called the noble rule system was firmly established in 1392. Since then, noble men tried to use state powers in controlling the social status of women. For this, they relied on lots of different discourses and ways. The purpose of this study was to investigate some of those discourses and ways. In the country, generally, noble men attempted to restrict women's activities within only one environment, that is, home and prohibit any religious involvement by women. in accordance with 『Sohak』. These attempts was ultimately to put social limitations on women. In a sense, however, the moves were inevitable in the ritualistic transition of the noble rule system from Buddhism or shamanism to Confucianism. Underlying the actions, nevertheless, was noble men's will to suppress women's sexual desires and make women a sexual subordinate to men.It was since the mid 17th century after both the Joseon-Japan War, or Imjinwaeran and the Joseon-China War, or Byeongjahoran when noble men began to be able to properly and fully satisfy their desires and purposes. Before that, men had usually moved to their wife's home after marriage, where they had and raised children. However, serious conflicts occurred between men and women as noble men forcedly changed the past customs of marriage life by relying on state powers. How those conflicts were are described enough in lots of literature including 『The True Records of the Joseon Dynasty』. So what made it possible for nobleman to realize their schemes since the mid 17th century? It may be attributed to the two wars as above mentioned, though not certain. Because of both the wars, the slavery system-based economy of the early Joeon period collapsed and almost all lands of the country became desolate. These situations decisively caused women to be prohibited from being heiresses. Of course, this presumption still need to be supported by more detailed evidence. Thus, that women lost their economic power may be the starting point of their tragedy.
