본 논문은 외국인에 대한 추방(강제퇴거) 절차와 이에 수반되는 보호조치(구금), 즉 통상 “이주 구금(immigration detention)”으로 불리는 제도가 국제인권법과 한국 헌법상의 기본권 보장체계에 부합하는지를 다면적으로 분석하고, 현행 출입국관리법 체계의 구조적 문제점을 규명한 후, 제도적·입법적 개선방안을 제시하는 것을 목적으로 한다.
오늘날 외국인에 대한 추방(강제퇴거) 및 보호조치(구금)는 단순한 출입국관리 행정을 넘어, 개인의 신체의 자유, 절차적 권리, 가족생활, 교육권 등 다양한 기본권에 중대한 영향을 미치는 문제로 대두되고 있다. 특히 출입국관리법 제63조에 따른 ‘보호조치’는 실질적으로 ‘행정 구금’의 성격을 가지면서도, 명확한 법적 요건과 구금 기간의 상한, 사법적 통제 절차가 부재하다는 점에서 지속적인 비판을 받아 왔다. 이러한 문제는 2023년 헌법재판소가 해당 조항에 대해 위헌 및 헌법불합치 결정을 내림으로써, 제도 개선의 필요성이 헌법적 차원에서 공론화되는 계기가 되었다.
이에 따라 2025년 6월 출입국관리법 개정을 통해 보호기간의 상한을 최대 9개월로 규정하고, 사법적·행정적 심사 절차, 구금 대안의 법적 근거, 취약계층 보호 규정 등이 도입되는 진전이 있었으나, 여전히 그 실효성, 절차적 독립성, 인권보장 기준의 구체성 측면에서는 여러 한계가 제기되고 있다.
본 논문은 외국인 추방(강제퇴거) 대상자의 권리보장을 위해 적용될 수 있는 국제인권법의 규범과 기준을 종합적으로 검토하였다.
국제연합 자유권규약(ICCPR) 제9조·제13조, 고문방지협약(CAT) 제3조, 아동권리협약(CRC), 유럽인권협약(ECHR), 국제법위원회(ILC) “외국인 추방에 관한 초안 조항(2014)” 등을 중심으로, 절차적 보장, 비례성원칙, 비자발적 송환 금지 원칙, 아동 및 가족 보호 기준을 분석하였다. 또한 UN 자유권위원회 및 유럽인권재판소(ECtHR)의 판례를 통해 각 기준의 해석 방향과 적용례를 고찰하였다.
이와 함께 미국, 프랑스, 일본 등 주요국의 출입국제도와 보호조치(구금)의 법적 구조를 비교법적으로 분석하였다. 미국의 구금 대안(ATD) 프로그램, 프랑스의 행정 구금에 대한 사법심사 제도, 일본의 장기보호 관행과 입법 동향을 살펴봄으로써 한국 제도의 한계를 구체화하고, 실현이 가능한 제도설계의 참고 사례를 제시하였다.
아울러 한국의 출입국관리법과 그 하위 시행령·시행규칙, 대법원 판례, 국가인권위원회 권고 등을 분석하여 현행 제도에서 나타나는 문제점을 절차 단계별로 정리하였다.
조사 단계에서는 권리 통지의무, 통역권, 변호인 조력권 등 기본적 절차보장의 미비를, 결정 단계에서는 보호명령 발부 과정의 독립성 부족과 법적 요건의 불명확성을, 이주 구금단계에서는 장기 보호의 문제, 가족 단위 보호의 남용, 실효성 없는 사법심사 구조를 비판적으로 분석하였다. 이러한 분석을 토대로 다음과 같은 입법적·정책적 개선방안을 제안한다. 첫째, 2025년 일부개정 출입국관리법은 보호조치의 기간을 원칙적으로 9개월로 제한하면서도, 일정한 연장 요건이 충족될 경우, 최장 20개월까지 보호조치를 지속할 수 있도록 규정하고 있다. 그러나 이러한 장기화 가능성을 내포한 규정은 국제인권규범이 요구하는 비례성원칙 및 최소기간 원칙과 충돌할 소지가 있다. 따라서 연장 시에는 반드시 사법적 심사 또는 독립적 행정심사를 의무화하여, 보호조치의 필요성과 비례성을 개별적·구체적으로 검증하는 절차적 통제를 강화할 필요가 있다. 둘째, 보호명령 발부 권한을 행정청으로부터 독립된 판단기관으로 이관하거나, 최소한 사전 또는 사후의 독립적 심사 절차를 법률에 명문화해야 한다. 셋째, 가족 단위 보호를 엄격히 제한하고, 특히 아동에 대해서는 원칙적으로 보호조치(구금)를 금지하며, 지역사회 기반의 대안적 보호조치를 마련해야 한다. 넷째, 추방(강제퇴거) 및 보호조치(구금) 명령 발부 시 비례성원칙을 법률상 요건으로 하고, 개인별 사정을 고려한 구체적 판단이 이루어지도록 절차를 설계해야 한다.
이에 따라 외국인 추방 및 이주 구금제도의 인권적 한계와 개선 필요성을 체계적으로 분석함으로써, 한국 출입국관리 체계의 헌법적·국제법적 정합성을 높이는 데 기여하고자 한다. 특히 헌법재판소의 위헌·헌법불합치 결정에 따라 2025년 출입국관리법의 일부개정이 이루어진 현시점에서, 국제인권규범과 비교법적 시사점을 종합적으로 제시한 본 연구의 분석과 제언은 향후 법령 개정과 정책 설계에 실질적인 참고자료로 활용될 수 있을 것이다.

This study aims to conduct a multifaceted analysis of whether the procedures for the expulsion(deportation) of foreigners and the accompanying protective custody(detention)—commonly referred to as “immigration detention”—are consistent with international human rights law and the constitutional framework for the protection of fundamental rights under the Korean Constitution. It further seeks to identify the structural problems inherent in the current Immigration Control Act system and to propose institutional and legislative reforms.
Today, the expulsion(deportation) and protective custody (detention) of foreigners have emerged as issues that go beyond mere immigration administration, exerting a significant impact on a wide range of fundamental rights, including personal liberty, procedural rights, family life, and the right to education. In particular, the “protective custody” provided for under Article 63 of the Immigration Control Act has been subject to persistent criticism for effectively constituting “administrative detention,” while lacking clear legal requirements, an upper limit on the duration of detention, and judicial oversight procedures. These issues came to the forefront at the constitutional level when, in 2023, the Constitutional Court declared the provision unconstitutional and incompatible with the Constitution, thereby creating momentum for institutional reform.
Accordingly, in June 2025, the Immigration Control Act was amended to establish a maximum detention period of nine months, introduce judicial and administrative review procedures, provide a legal basis for alternatives to detention, and incorporate provisions for the protection of vulnerable groups. However, despite these advances, numerous limitations continue to be raised regarding the effectiveness of these measures, the procedural independence of the review mechanisms, and the specificity of the human rights protection standards.
This study comprehensively examines the normative standards under international human rights law applicable to the protection of individuals subject to expulsion(deportation).
It analyzes key instruments—such as Articles 9 and 13 of the International Covenant on Civil and Political Rights (ICCPR), Article 3 of the Convention against Torture (CAT), the Convention on the Rights of the Child (CRC), the European Convention on Human Rights (ECHR), and the International Law Commission (ILC)’s Draft Articles on the Expulsion of Aliens (2014)—focusing on procedural guarantees, the principle of proportionality, the prohibition of involuntary return, and the protection of children and families. The study further explores the interpretation and application of these standards through the jurisprudence of the UN Human Rights Committee and the European Court of Human Rights (ECtHR).
In addition, this study conducted a comparative legal analysis of the immigration systems and the legal frameworks governing protective custody (detention) in major countries, including the United States, France, and Japan. By examining the alternatives to detention (ATD) programs in the United States, the system of judicial review of administrative detention in France, and the practices of long-term detention and legislative trends in Japan, this research has identified the specific limitations of the Korean system and presented practical reference models for institutional design that can be feasibly implemented.
Moreover, by analyzing the Korean Immigration Control Act, its subordinate regulations, Supreme Court precedents, and recommendations by the National Human Rights Commission, the study systematically categorizes the problems that arise at each procedural stage.
At the investigation stage, it identifies deficiencies in basic procedural safeguards, such as notification of rights, the right to interpretation, and access to counsel. At the decision-making stage, it examines the lack of institutional independence in issuing protection orders and the ambiguity of the legal requirements governing such orders. In the immigration detention stage, the study assessed problems such as prolonged detention, the abuse of family-based detention, and the ineffectiveness of the judicial review system. Based on this analysis, the study proposes the following legislative and policy reforms.
First, while the 2025 partial amendment to the Immigration Control Act in principle limits the duration of protective custody to nine months, it also provides that, if certain extension requirements are met, detention may be continued for up to a maximum of twenty months. However, such provisions, which allow for the possibility of prolonged detention, risk conflicting with the principles of proportionality and minimum duration required under international human rights norms. Accordingly, it is necessary to strengthen procedural safeguards by mandating judicial review or independent administrative review for any extension, in order to verify, on an individualized and concrete basis, the necessity and proportionality of continued detention.
Second, the authority to issue protection orders should be transferred to an adjudicative body independent of the administrative agency, or at a minimum, independent pre- or post-review procedures should be explicitly stipulated by law.
Third, family-based detention should be strictly limited, and in particular, protective custody(detention) of children should, in principle, be prohibited. Instead, community-based alternative care measures should be established.
Fourth, when issuing expulsion(deportation) and protective custody(detention) orders, the principle of proportionality should be codified as a legal requirement, and procedures should be designed to ensure individualized assessments that take into account the specific circumstances of each person.
Accordingly, by systematically analyzing the human rights limitations of the deportation and immigration detention systems and the need for their reform, this study seeks to contribute to enhancing the constitutional and international law consistency of Korea’s immigration control framework. In particular, in light of the 2025 partial amendment of the Immigration Control Act following the Constitutional Court’s decisions of unconstitutionality and incompatibility with the Constitution, the analysis and recommendations presented in this research—which comprehensively draw on international human rights norms and comparative legal insights—can serve as a practical reference for future legislative amendments and policy design.
