교육을 받을 권리의 자유권적 성격과 내용

다국어 초록 (Multilingual Abstract)

Article 31 paragraph1 of the Korean Constitution guarantees right to education. This right comprises three disparate elements of rights: Equality, social welfare and constitutional liberty(freedom of education). Characteristics and importance of the last element, on which less inquiry has been cast, should be recognized.
As Article 31 builds public education system, competence and responsibilities of state authorities play considerable role. Nonetheless the free status of relevant parties should be respected and protected somehow in the public education system, for autonomy and independence are essence of education.
Constitutional grounds for freedom of education can be found within the education article(Article 31), not outside of it(like Article 10 or Article 36). Ground for the students can be found in Article 31 paragraph1, while that for the parents can be found in the combination of Article 31 paragraph1 and Article 36 paragraph1.
There are several important issues on education that need and fit analyses in terms of freedom of education. Refusal to be educated including elementary education, Home-schooling, Exclusion from school, Choice of school, Denial of Indoctrination from state authorities as in the case of state-written textbook.
General theories concerning the constitutional liberties can be applied when limitations on the educational freedom matters.
