국문 초록 (Abstract)

국가 간 비교연구를 통한 전자위치추적제도의 개선방안

본 연구의 목적은 국가 간 비교를 통해 한국의 전자위치추적제도의 개선 방안을 모색하는 것 이다. 2008년 9월 성폭력범죄자에 대한 전자발찌제도를 도입한지 약 6년이 지난 시점에서 아직도 불거지고 있는 전자발찌 제도의 실효성과 법적논란, 미비점 등을 전자위치추적제도를 시행하고 있는 다른 국가들과의 비교연구를 통해 살펴보아 전자발찌제도의 법률적, 실질적 시행의 안정을 도모하고, 성범죄 예방책으로서 전자위치추적제도가 실효성 있는 제도로 운영되기 위한 개선책을 강구할 목적으로 다음 연구를 하고자 한다.
사회문제로서 성범죄의 심각성 및 예방제도의 정책적 중요성에도 불구하고 현재 충분한 연구가 이루어지지 않고 있다. 그 동안 많은 연구에서 전자발찌의 효과성에 대해 다루었지만, 이 제도를 시행하고 있는 다른 국가들에 비해 처벌의 수위가 낮고, 처벌이라는 단적인 측면에만 집중하고 있다는 점과 이에 대한 법률적인 논쟁이 아직까지 지속되고 있다는 점에서 이 제도의 쟁점을 분석하고, 타국과의 비교연구를 통해 개선해야 할 부분을 연구하여 안정적으로 정착시킬 필요가 있다. 성폭력 범죄는 일단 범죄가 발생하면 그 폐해로 인한 파급 효과가 피해자 개인 뿐 아니라 사회 전반으로 나타나며, 사회 전체의 안정감을 해치고 그 위기지속력 또한 타 범죄에 비하여 강하게 나타나므로 효과적인 예방과 처벌에 대한 방안이 시급하게 마련되어야 한다.

The purpose of this study is the proposal the improvement of Korea based on other countries related electronic monitoring system. This paper will have a careful look the realities of sexual violence in Korea and analyze the issues about this system and comparisons with other countries that need to be improved through several research and research needs to be settled and stable.
Recently, sexual violence occurred in succession and became serious problem in Korea. The chain of events caught huge interest of mass media and people began to think that legal system is lenient with habitual sex offenders. In accordance with criminal justice system in South Korea had to develop means of intensive supervision for sex offenders. One of the most radical changes is the introducing electronic monitoring system. Electronic monitoring(EM) for sex offenders by using GPS(Global Positioning System) has been introduced in 2008 in Korea.
Controversial debate on a legislative bill is still crucial topic between policy makers and scholars. Some people criticise that those measures are double punishment and trample upon personal human rights. But another people insist that those are necessarily conditions to reduce and manage the risk of repetition of sexual violence. There are something issues in electronic monitoring system. Examples of Legal Issues, electronic monitoring programs fee, Impact on the Family members, effect of crime deterrence. Several of the institutional problems of the issue is the lack of person in charge, information linkage member, and machine-related issues. We have to solve these problems for successful electronic monitoring system. First, Korea has been successfully operating in the electronic monitoring system that can support them to become human and material resources to be provided. Second, In order to contribute to the elimination of the sex crimes, including high-risk sex offenders and minor dedicated system to comprehensively manage the one-stop system is needed. Third, in order to operate Electronic monitoring system effectively, constant effort to improve the device performance is required. Fourth, we need to medicare and Community Attendance Center Orders to electronic monitoring criminal. the development of a professional treatment program is urgently required for managing high-risk sex offenders.
The government took a series of countermeasures to reduce danger of repetition of sexual offences and contribute to social stability. In particular, electronic monitoring system was introduced to prevent any recurrence of sexual abuse of those who are highly probable of commit crimes again. Despite the proven effectiveness, electronic monitoring system is not only the key to solve. Through the merging of different systems and can demonstrate the high effectiveness of countermeasures should be discussed.
