부적절한 법정지 법리는 분쟁이 된 사건에 대해 대체적 법정지에서 해결하기에 더 적절한 경우, 법원으로 하여금 국제재판관할권을 불행사할 수 있도록 한다. 재판관할이 인정되는 경우에도, 외국 법원이 분쟁 해결에 보다 적절하다고 판단되면, 법원이 관할권 행사를 거부할 수 있도록 하는 재량권을 부여한다. 보통법계 국가에서 부적절한 법정지 법리가 있다면, 대륙법계 국가에는 국제적 소송경합 원칙이 존재한다. 국제적 소송경합 원칙은 동일한 당사자 간 동일한 소송이 두 개 이상의 국가에서 계속 중인 경우, 후소법원이 전소법원을 위해 관할권 행사를 거부하는 것을 말한다.
우리나라는 2022년 국제사법을 전부개정하면서 국제재판관할규칙을 전면적으로 정비하였다. 특히 주목할 점은 보통법계의 전유물로 여겨졌던 부적절한 법정지 법리를 도입하였다는 것이다. 국제사법 제12조에 부적절한 법정지 법리에 관한 규정을 마련하여, 법원에 일정한 재량을 부여하고, 이로써 구체적인 사건에서 국제재판관할을 합리적으로 배분할 수 있도록 하였다. 아울러 국제사법 제11조에서는 동일한 소송에 관한 국제적 소송경합 원칙을 따르는 규정을 마련하였다. 다만, 우리 법원에서 해당 사건을 재판하는 것이 외국법원에서 재판하는 것보다 더 적절함이 명백한 경우에는 국제적 소송경합 원칙이 적용되지 않는다. 이는 부적절한 법정지 법리가 역으로 적용되는 경우로, 선소우선주의의 경직성을 완화하는 기능을 수행한다.
이처럼 우리나라는 국제적 소송경합과 부적절한 법정지 법리를 하나의 법에 병존시켜 법적 안정성과 예측가능성을 확보하면서도 유연성을 부여하고 있다. 한편, 이 두 법리가 적용될 수 있는 경우라 하더라도 당사자 간 국제재판관할합의가 존재하는 경우에는 그 적용이 배제된다. 부적절한 법정지 법리를 연구하는 데 있어, 국제적 소송경합 원칙과 국제재판관할합의를 함께 살펴보는 것은 부적절한 법정지 법리에 관한 심도 있는 이해를 가능하게 한다. 이에 본고에서는 부적절한 법정지 법리를 연구함에 있어, 국제적 소송경합, 그리고 국제재판관할합의와의 관계를 각 분석한다.
국제사법 제12조에 의하면, 법원에 국제재판관할이 있는 경우라도 국제재판관할권을 행사하기에 부적절하고 국제재판관할이 있는 외국 법원이 분쟁을 해결하는 데 보다 적절하다는 예외적인 사정이 명백히 존재할 때 법원이 관할권의 행사를 거부할 수 있다고 명시하고 있다. 그러나 국제재판관할권을 불행사할 수 있는 판단 기준이 불분명하다. 결국 이는 법관의 해석에 맡겨져 있어, 자의적인 해석을 가능하게 한다. 제12조의 적용여부를 판단하기 위해, 사건 및 소송당사자와 관련한 모든 사정을 고려해야 할 것인데, 이때 사익적 요소를 고려하는 것은 당연하나, 공익적 요소도 고려대상이 되는지에 대해서는 논란의 여지가 있다. 그러나 조문에서 명백한 예외적 사정을 요구하는 점에서, 사익적 요소를 중심으로 심사하되 공익적 요소도 고려하는 것이 타당할 것이다. 더 나아가 법리 판단의 구체적 기준과 관련하여, 우리 법원은 과거 소위 도메인이름 사건에서 국제재판관할권의 존부에 대해 판단한 바 있다. 당시 판결에서 판시했던 내용을 고려하여, 법리 판단 시 반드시 고려해야 하는 요소를 규범화하는 방안을 검토해 볼 수 있다.
소송절차와 관련하여, 보통법계 국가들은 부적절한 법정지 법리에 따라 소송절차를 중지하거나 소를 각하할 때 일정한 조건을 부가한다. 우리나라에는 이에 관한 명시적 규정이 없으나, 국제사법에 해당 법리를 도입한 취지를 살리고 외국법원에서 원고의 사법접근권을 보장하기 위해서는, 실현 가능한 범위 내에서 과도하지 않은 조건을 부가하는 것이 적절해 보인다.
한편 국제사법의 국제적 소송경합에 관한 규정에서는 동일한 소송에 대해서만 소송절차 중지를 명문으로 규정하고 있으나, 관련 소송에 대한 명시적인 규정이 존재하지 않는다. 만약 관련 소송이 존재한다면 부적절한 법정지 법리의 판단 요소 중 하나로 고려할 수 있을 것이나, 무엇보다 향후에는 관련 소송에 대한 입법적 보완이 필요해 보인다. 끝으로, 당사자 간에 우리 법원을 관할 법원으로 정한 국제재판관할합의가 존재하는 경우에는, 부적절한 법정지 법리는 적용되지 않는다. 그런데 전속관할이 우리나라 법원에 있는 경우에도 부적절한 법정지 법리의 적용이 배제되는지에 대해서는 명시적인 규정이 없다. 생각건대, 전속관할이 우리 법원에 있는 경우에는 그 분쟁의 성질상 우리나라에서 해결하는 것이 적절하므로, 이때에도 법리의 적용이 배제된다고 보는 것이 타당하다.
우리나라가 부적절한 법정지 법리를 도입한 것은 대륙법계가 지닌 경직성을 보완하고 국제분쟁 해결에 있어 유연성을 확보하려는 노력의 일환이다. 다만, 그 적용 기준이 명확하지 않아 다양한 해석의 여지를 남기고 있다. 이 법리가 남용되지 않고 안정적으로 정착되기 위해서는 법원이 요건을 신중하게 심사하고, 구체적이며 명확한 적용기준을 마련하는 것이 요구된다.

The doctrine of Forum Non Conveniens allows a court to decline the exercise of international jurisdiction when an alternative forum is deemed more appropriate for resolving the dispute. Even where jurisdiction is recognized, the court retains discretion to refuse to exercise jurisdiction if it determines that a foreign court is better suited to resolve the dispute. While forum non conveniens is a principle recognized in common law countries, the principle of international lis pendens(parallel proceedings) exists in civil law countries. The latter provides that when proceedings involving the same cause of action and between the same parties are pending in two or more countries, the court second seised must decline jurisdiction in favor of the court first seised.
In 2022, South Korea enacted a comprehensive revision of its Private International Law, overhauling its rules on international jurisdiction. Notably, the revised law introduced the doctrine of forum non conveniens, which had traditionally been considered unique to common law systems. Article 12 of the revised Private International Law includes this doctrine, granting courts a measure of discretion to reasonably allocate international jurisdiction in specific cases. Furthermore, Article 11 addresses the principle of parallel proceedings for identical lawsuits. However, this principle does not apply if it is clearly more appropriate for the Korean courts to hear the case than a foreign court. This functions as a reverse application of Forum Non Conveniens, serving to mitigate the rigidity of the first in time ruls.
Through these developments, by coexisting the principles of international Lis Pendens and Forum Non Conveniens within a single legal framework, Korea ensures legal certainty and predictability while also providing for flexibility. Nevertheless, if there is a valid choice-of-court agreement between the parties, both doctrines are excluded from application. To understand the doctrine of forum non conveniens, it is essential to examine the doctrine in conjunction with both the principle of international Lis Pendens and choice-of-court agreements. Accordingly, this thesis analyzes the relationship between international parallel proceedings and the choice-of-court agreement, focusing on the doctrine of forum non conveniens.
According to Article 12 of the Private International Law, even when a court has international jurisdiction, the court may decline to exercise such jurisdiction when there clearly exist exceptional circumstances in which exercising jurisdiction is inappropriate, and a foreign court that has international jurisdiction is more suitable for resolving the dispute. However, the criteria for declining to exercise international jurisdiction remain unclear. Ultimately, this leaves the interpretation to the discretion of judges, potentially allowing for arbitrary interpretations. In order to determine whether Article 12 applies, all circumstances related to the case and the parties involved must be considered. While it is natural to consider private interest factors in this assessment, there is controversy regarding whether public interest factors should also be taken into account. However, given that the article explicitly requires clear exceptional circumstances, it would be reasonable to primarily analyze private interest factors while also considering public interest factors. Furthermore, regarding specific criteria for legal judgment, the Korean Supreme Court has previously ruled on the existence of international jurisdiction in the so-called domain name case. Considering the rulings made in the aforementioned domain name case, it may be worth considering the possibility of standardizing the essential factors that must be taken into account when making such legal judgments.
With regard to litigation proceedings, in common law countries, when courts stay or dismiss legal proceedings based on the doctrine of forum non conveniens, they often attach specific conditions to their decisions. Although the Korean statute provides no explicit provisions concerning this point, to uphold the intent behind adopting this legal doctrine in the Private International Law and to ensure the plaintiff's access to justice in foreign courts, it seems appropriate to impose reasonable conditions within a feasible scope.
Meanwhile, while Korea's Private International Law explicitly stipulates the suspension of legal proceedings only for identical actions under its parallel proceedings provision, there are no explicit provisions concerning related actions. While the existence of related actions could be considered a factor in determining the application of the doctrine of forum non conveniens, it appears that legislative supplementation for related actions will be necessary in the future. Finally, the doctrine of forum non conveniens does not apply when there is a choice-of-court agreement between the parties designating a Korean court as the court of jurisdiction. However, there is no explicit provision as to whether the doctrine of forum non conveniens is also excluded in cases where exclusive jurisdiction lies with the Korean court. It is reasonable to conclude that if exclusive jurisdiction rests with Korean courts, the application of the doctrine should be excluded. This is because the nature of such disputes makes resolution within Korea inherently appropriate.
The introduction of the doctrine of forum non conveniens by Korea is part of an effort to supplement the rigidity of the civil law system and to secure flexibility in resolving international disputes. However, the criteria for its application are not clear, leaving room for various interpretations. For this doctrine to be stably established and prevent misuse, it is required that the court carefully examines the requirements and establishes concrete and clear criteria for its application.
