국제법상 유럽인권협약이 헌법적 기능을 가지고 있고, 유럽인권재판소가 헌법재판소로서 기능하는지 여부는 아직 해결되지 않은 문제이다. 그러나 현재 유럽인권재판소가 독특한 형태의 준헌법재판소이고, 유럽의 기본권 문제를 다루고 있다는 점에서 헌법적 문제를 결정하는 기구라는 점은 의심의 여지가 없다.
유럽인권협약이 사회적 및 경제적 권리를 규율하고 있는 유럽사회헌장과 달리, 주로 시민적 및 정치적 권리를 규정하고 있어 모든 기본권을 아우르고 있지 않다는 사실과 회원국이 증가하고 개인청원제도가 보다 대중에 널리 알려지게 되어 유럽인권협약의 핵심적 제도인 개인청원의 건수가 폭발적으로 증가한 점에서 효율성에 문제가 제기되었다. 그러나 유럽심의회 회원국들은 이 문제에 대처하기 위해 추가의정서를 채택하여 기본권의 확장과 효율성 문제를 해결하려 하였고, 유럽인권협약이 회원국에 헌법적 기능을 수행하여야 하는지 여부와 유럽인권재판소의 미래에 관하여 보다 많은 관심과 논의가 촉발되었다. 특히, 유럽인권재판소가 유럽인권협약이 ‘유럽 공공질서의 헌법적 문서’를 구성하며, 동 협약이 객관적 의무를 창설한다고 판결하여 온 것은 주목할 만하다. 또한 2007년 리스본조약이 발효하게 되면 유럽연합이 유럽인권협약에 가입하게 될 것이고, 이는 유럽연합 기관들의 인권침해행위에 관하여 유럽인권재판소가 사법심사권을 갖게 되는 것이다.
독일 국내법원과 학계의 유럽인권협약의 지위와 관련한 입장을 살펴보는 것도 중요한 의미를 가지는데, 이를 위해 2004년 Görgülü 사건에서 독일연방헌법재판소가 내린 판결을 살펴볼 필요가 있다. 동 사건에서 헌법재판소는 독일 기본법상 법치주의 원칙은 유럽인권협약을 준수하고 유럽인권재판소의 판결을 고려할 의무를 포함하는 것으로 독일 국내법원은 물론이고, 행정 및 입법 기관 모두 유럽인권협약 및 유럽인권재판소의 판결을 준수해야 한다고 판결함으로써, 유럽인권협약이 독일법상 연방법 이상의 헌법적 지위를 가지고 있음을 강조하였다.
결론적으로 유럽인권협약의 헌법적 기능은 강화되어야 할 것인데, 유럽인권재판소는 인권, 민주주의, 법치주의에 기초한 유럽공공질서를 설립하는데 필요한 헌법적 결정에 집중해야 한다. 이는 유럽인권협약이 실제적인 국내 인권 보호를 위한 유럽차원의 공통된 최소한의 기준을 확립하는데 기여할 것이다.

It is still under discussion whether the European Convention on Human Rights has constitutional functions under international law and the European Court of Human Rights is a constitutional court. However, it is true that the Court, at present, a quasi-constitutional court sui generis and it is an institution to decide constitutional questions in that it deals with fundamental rights within Europe.
Unlike the European Social Charter which regulates social and economic rights, the European Convention on Human Rights generally provides civil and political rights instead of all the fundamental rights. In addition, individual application which is an essential system of the Convention caused a problem of effectiveness with the extreme increase of application number because the parties to the Convention significantly increased and it was well known to the public. However, the member states of the Council of Europe sought to solve these problems by adopting additional protocols, since then, the fierce debate as to if the Court should carry out as a constitutional court in the member states and how the Court should move forward in future was triggered. In particular, the holdings of the Court needs to be noted that the European Convention on Human Rights constitutes a constitutional instrument of European public order and it creates objective duties. Besides, if the Lisbon Treat of 2007 enters into force, the European Union shall accede to the Convention and it means that the European Court of Human Rights shall review the acts of institutions of the Union.
The German Federal Constitutional Court concluded in the Görgülü case that the principle of the rule of law under the German Basic Law includes the obligations to respect the European Convention on Human Rights and consider the rulings of the European Court of Human Rights. It also pointed out that the Convention has constitutional rank over federal law under the German law by holding that the courts as well as the administrative and legislative organs should ensure the provisions of the European Convention on Human Rights and the decisions of the European Court of Human Rights.
To conclude, the constitutional functions of the Convention should be strengthened and the Court ought to focus on the constitutional judgments necessary to establish the European public order which is based on human rights, democracy and the rule of law. Finally, it will contribute to making European common minimum standards for domestic human rights protection.
