뉴질랜드는 불문헌법 국가로서 의회가 절대적인 권한을 행사하고 있다. 그에 따라 뉴질랜드는 인권과 일치하지 않는 입법을 폐기할 수 없는 국가 중 하나이다. 이것은 의회가 국내 및 국제 인권과 원주민들의 권리보다 우위에 있을 수 있는 식민지 법원칙의 유산이다.
따라서 이렇게 인권침해적 법률에 대하여 사법심사가 가능하지 않은 뉴질랜드에서 입법부와 행정부 그리고 사법부의 인권침해적 행위에 대하여 인권위원회가 수행하는 역할은 클 수밖에 없다. 즉 인권위원회는 국제인권규범과 국내적, 헌법적 그리고 다른 법적 의무를 국내적으로 시행하는 데 중심적인 구실을 하고 있다. 한 나라를 지배하는 (입법부와 집행부) 업무와 정의 관리(사법부)를 부여 받은 다른 국가기구와 달리 인권위원회의 독점적 권한은 인권을 보호하고 촉진하는 것이다. 다른 기구의 다양한 기능도 인권의 보호와 촉진을 보장할 수 있기는 하지만, 인권 보호와 촉진은 인권위원회의 핵심적 목표이자 근본적 목적이다.
또한 인권위원회는 정부의 투명성과 책임성을 고양시킴으로써 시민사회 적극주의를 강화할 수 있게 한다. 인권위원회 업무의 확장은 통치체계 내에서 투명성과 책임성 결핍으로부터 생기는 문제들을 감독할 수 있게 보장한다. 민주적 통치는 시민선출 정치인에게 공직을 맡기는 것뿐 아니라 정국민들이 실제 통치과정에서의 발언을 완수케 하는데, 그것은 정책 시행을 위한 자문과정을 통하여 정치적으로 참여하는 것까지 포함한다. 인권상황에 대한 그 긍정적 효과는 인권침해에 대한 대표적인 사례에서 진가가 발견될 수 있다.

The Role of the Human Rights Commission in New Zealand

New Zealand("NZ") doesn't have a singular written constitution. It instead has a number of sources, including legislation such as the Constitution Act of 1986 and the New Zealand Bill of Rights Act(BORA) 1990, constitutional conventions, international law, and the Treaty of Waitangi. And NZ is one of the only countries in the world where legislation cannot be overturned for inconsistency with human rights. This inherited colonial legal principle means that Parliament can, and does, override both domestic and international human rights.
So the New Zealand Human Rights Commission(NZHRC) have come to occupy a central role in the domestic implementation of both international human rights norms and domestic, constitutional, and other legal obligations. Unlike other institutions, which are vested with the task of governing a country (legislature and executive) and the administration of justice(judiciary), NZHRC's exclusive mandate is to protect and promote human rights, this is the core mission and fudamental purpose of NZHRC.
NZHRC is thus able to empower civil society activism, leading to greater government transparency and accountability. Expanding the work of NZHRC would ensure that it can monitor matters essentially arising out of a lack of transparency and accountability within the governance system. Democratic governance would encompass citizens actually having a say in the governance process, including political participation through consultative processes for policy implementation. Its positive effects on the human rights situations may be appreciated in light of some glaring cases of human rights violations.
