초․중등교육에 관한 지방자치단체의 역할과 책임 분석: 한국과 프랑스의 사례 비교

국문 초록 (Abstract)

최근 정부는 지방자치와 학교 자율화 확대 차원에서 중앙정부의 권한과 책임을 지방과 단위학교로 점차 이전하는 정책을 추진하고 있다. 그러나 이 과정에서 중앙정부가 담당해야 할 정당한 개입과 책임까지 간과될 수 있다. 이러한 문제인식에서 이 연구에서는 초중등교육에 대해 국가와 지방자치단체가 각기 담당해야 할 역할과 책임 그리고 학교교육의 질적 수준을 보장하기 위한 제도와 지방자치단체의 책무성은 무엇인가를 분석하고자 하였다. 교육에 대한 국가와 지방자치단체의 역할과 책임은 개별 국가의 정치, 경제, 사회적 배경에 따라 달라질 수밖에 없다. 따라서 이 연구에서는 우리나라와 유사한 중앙집권적 행정 전통을 가지고 있으면서 최근 지방자치단체의 권한과 책임을 확대하고 있는 프랑스의 사례를 비교·분석하는 방법을 활용하였다. 외국의 사례를 비교·분석하는 것은 우리나라의 정책과 제도를 새로운 시각에서 조망해볼 수 있는 기회가 된다. 구체적으로 이 연구에서는 네 가지 질문에 답하고자 하였다. 첫째, 한국과 프랑스의 교육체제와 교육행정체제는 어떻게 구성되어 있는가 둘째, 초중등교육의 핵심 분야인 교육과정, 인사, 재정 등에서 중앙정부와 지방자치단체 간 역할과 책임은 어떻게 분담되어 있는가 셋째, 초중등교육의 질 보장과 초중등교육에 대한 지방자치단체의 책무성을 확보하기 위해 어떤 제도들이 시행되고 있는가 넷째, 프랑스의 사례는 한국의 지방분권, 중앙정부와 지방자치단체의 역할과 책임 정립에 어떤 시사점을 제공하는가 연구문제 해결을 위한 관련 문헌과 자료 분석, 프랑스의 교육부 관계자, 교사 등을 면담한 결과 밝혀낸 주요 연구결과는 다음과 같다.
첫째, 프랑스에서 교육은 국가(중앙정부)의 '책임'으로 헌법과 교육법에 명시하고 있다. 이에 따라 지방자치 확대에도 불구하고 교육에 있어 중앙정부의 권한과 책임은 강하게 유지되고 있다. 프랑스의 지방자치단체는 광역자치단체인 레지옹, 중역자치단체인 데파트망, 기초자치단체인 꼬뮌으로 구분되며, 이들 지방자치단체 간에는 위계적인 계층 서열은 없으며 기능을 달리할 뿐이다. 각 지방자치단체별로 학교교육에 관한 책임과 사무가 명확하게 설정되어 있는데, 레지옹은 고등학교, 데파트망은 중학교, 꼬뮌은 유·초등학교의 시설과 운영을 책임지고 있다. 이러한 지방자치단체와는 별도로 국가교육 실행을 위해 레지옹 수준에 아카데미를 설치하고 아카데미를 중심으로 국가교육행정체제가 편성되어 있다. 또한 각 지방자치단체에서 국가교육정책이 일관되게 적용, 실행되도록 하기 위해 중앙정부 대표가 파견되어 있는데, 이들은 교육부장관과 아카데미의 장인 교육감의 관할 하에 각 지역의 초중등교육과 교원 전

The purposes of this study are to analyze and compare the roles and responsibilities of the central government and the local government for the public education among Korea and France. This research theme is based on the thoughts that recent decentralization movements and school autonomy policies in Korea triggered the needs for reshuffling the roles and responsibilities of central and local governments for public education. Based on these thoughts, four research questions were developed: First, how the school education system and educational administration system are organized in both countries What are the roles and responsibilities for the public education How they are shared between central government and local government Second, what are roles and responsibilities of the central government and local government on the main areas of educational governance such as school curriculum, teachers' personnel management, and education finance Third, what are systems and policies to assure the quality of the public education What are the mechanisms and means to make local government accountable to local public education Fourth, what are the differences and common grounds between Korea and France in terms of those three questions above and what are the policy implications for Kor
