    이 연구는 동남아 국가들의 인권 현황과 인권정책을 포괄적으로 살펴보고, 지역협의체인 아세안(SAEAN)을 중심으로 한 이들 국가들의 인권 개선을 위한 지역협력 수준을 분석하여 인권과 정치체제, 그리고 지역협력 사이의 상관관계를 고찰하는데 주요 목적이 있다. 이를 위해 이 연구는 동남아 지역에서 민주화가 이루어진 필리핀, 태국, 인도네시아를 중심으로 이들 국가들의 인권 개선을 위한 제반 정책과 지역협력 수준을 국가(정부)와 시민사회(인권단체) 사이의 관계 및 아세안을 중심으로 한 인권협력 활동 등을 통해 고찰하였다. 연구 결과, 동남아 국가들의 인권 현황과 인권정책, 그리고 지역협력 수준은 다른 지역 및 국가들과 비교하여 열악한 수준을 크게 벗어나지 못하고 있다. 이것은 동남아 국가들이 국내적으로 처한 정치구조나 경제적 환경이 어렵기 때문이기도 하지만, 인권을 국가주권과 경제성장을 침해하는 요인으로 간주하는 각국의 부정적 인식과 태도 때문이기도 하다. ‘아시아적 가치’ 논쟁이나 아세안의 ‘불간섭 원칙’에서 찾아 볼 수 있듯이 동남아 국가들은 과거 서구 열강에 의한 오랜 식민지배의 유산으로 국내의 인권 문제에 대한 외부적 간섭과 개입을 국가주권 차원에서 민감하게 반응하였으며, 특히 아세안 차원에서도 인권 개선을 위한 지역협력의 전향적 대안을 모색하지 못하여 왔다. 인권운동을 전개하는 국가․지역 단위의 인권단체들 역시 국내 정치적 환경과 재정적 한계에 기인하여 원활한 연대활동을 추진하지 못하고 있는 상태이며, 특히 아세안이 지니는 구조적 한계와 맞물려 지역적 공조나 연계활동이 원활하게 이루어지지 못하고 있다. 결과적으로 정치체제의 민주적 속성과 연계된 인권 개념은 동남아 국가들에게서 시사하는 바가 매우 크다. 즉, 동남아 국가들의 정치적 민주화와 민주주의 이행, 그리고 민주주의 공고화가 보다 빠르게 촉진될수록 이들 국가들의 인권 상황도 보다 포괄적 차원에서 점진적인 개선이 이루어질 수 있다는 사실이다. 동남아 혹은 보다 폭넓은 범주에서 동아시아의 지역협력과 공동체 형성이 보다 활발하게 추진되기 위해서도 필연적으로 인권 문제에 대한 대화와 협의를 통해 국가 간, 시민단체 사이의 연대나 지역협력을 강화하는 다양한 정책적 대안들이 모색되어야 할 것이다. 그리고 마지막으로 국가 간 주권과 문화적 특수성을 인정한다고 하더라도 동남아 역내 국가들 사이의 합의를 통해 통용될 수 있는 인권의 보편적 개념이 확립되어야 할 것이며, 이것을 위해서는 아세안을 중심으로 인권 문제를 해결하기 위한 지속적인 노력이 경주되어야 할 것이다.

    The main purpose of this study is to explore the relationship between human rights, political regime, and regional cooperation by examining the present status of human rights and human rights policies, and by analyzing the level of regional cooperation for human rights improvement in Southeast Asian Countries. For this research purpose, this study is to analyze the relations between state (government) and civil society (human rights groups) of the Philippines, Thailand, and Indonesia, who were democratized, and their regional cooperation activities in the ASEAN (Association of Southeast Asian Nations). As a research result, the level of human rights situation, human rights policies, and regional cooperation in Southeast Asia was inferior than other regions and countries. The reasons of these results were not only caused by domestic political structures and economic situations of Southeast Asian countries, but also due to their negative cognitions and attitudes toward human rights, which was regarded as a obstacle to their state sovereignties and economic development. As we observed the dispute of ‘Asian value’ and the doctrine of ‘non-interference’ in the ASEAN, Southeast Asian countries responded sensitively to outside countries' interference for human rights in the dimension of state sovereignty, because of the old legacy of long colonial reign by the Western countries. The ASEAN, as an regional consultant body, also could not explored ways toward epochal alternatives for human rights improvement in the region. In the national or regional level, civil society groups, which propelled human rights movements, did not tried to develop the regional solidarity activities because of political environment and financial limitations. The ASEAN was not still prepared for regional cooperation and mutual assistance of these groups. In conclusion, the concept of human rights, which was linked with democratic attribute of political regime, suggests a lot of implications for Southeast Asian countries. That is, as fast as democratization, translation of democracy, and democratic consolidation of Southeast Asian countries is promoted, the situations of these countries will be better progressively and step by step. For the Southeast or East Asian regional cooperation and community building, it must be continued to endeavor for conversation and consultation between interstates, and governments and civil society groups, and to grope for alternative policies for the improvement of human rights. And, lastly, although it concede interstate sovereignty and cultural speciality, It must be settled the universal concept of human rights by the consultation among Southeast Asian countries, and persevered in the ASEAN's efforts for resolving the human rights problems in Southeast Asia.
