당선인 결정의 민주적 정당성에 관한 연구: 무투표 당선과 동수 득표 시 당선인 결정 방법을 중심으로 = The Study of Democratic Legitimacy about Uncontested elections and Tied elections

국문 초록 (Abstract)

민주주의 사회에서 다수결 원칙은 정치적 정당성의 근거를 제공하여 선출된 대표자가 다수의 의사를 반영할 수 있도록 한다. 그러나 무투표 당선이나 동수 득표와 같은 방식으로 유권자의 선택이 반영되지 않은 채 당선자가 결정되는 경우는 민주적 정당성을 훼손할 가능성이 있다. 우리나라의 경우 무투표 당선은 후보자 수와 선출 의석수가 동일할 때 발생하며, 동수 득표 시 연장자를 우선하는 규정을 적용하여 당선자를 결정하고 있다. 이러한 상황은 민주적 대표성과 투표권의 평등한 적용에 있어서 중요한 문제를 제기한다. 이 글은 무투표 당선과 동수 득표 상황에서의 당선인 결정 방식에 초점을 맞추어 우리나라의 현행 법규정과 운영상의 문제를 검토하고, 지방선거 사례들을 통해 경쟁 없는 선거가 민주적 정당성에 미치는 영향을 분석하였다. 또한, 해외 사례를 통해 대안을 모색하여 선거 결과의 민주적 정당성을 제고할 수 있는 방안을 제안하고자 한다.

In democratic societies, the principle of majority rule forms the foundation of political legitimacy, allowing elected representatives to reflect the will of the majority. However, when candidates are elected without a vote or by tiebreakers that bypass voters’ choices, democratic legitimacy can be compromised. In South Korea, uncontested elections occur when the number of candidates matches the number of available seats, and in cases of tied votes, the older candidate is given priority. These situations raise significant concerns about democratic representation and the equal application of voting rights. This article examines South Korea’s current legal provisions and practical challenges surrounding methods for determining winners in uncontested and tied elections. By analyzing the impact of non-competitive elections on democratic legitimacy through local election case studies, it also considers international practices to suggest ways of strengthening the democratic integrity of election outcomes.
