회복적 사법에 대한 비판적 검토 = A critical review on restorative justice

국문 초록 (Abstract)

범죄문제의 새로운 사법정책으로 회복적 사법에 대해 최근 많은 관심이 집중되고 있다. 본 논문의 목적은 회복적 사법의 이론적 문제와 시행과정에서의 문제를 분석해 회복적 사법의 발전가능성을 비판적으로 검토하는 것이다.
이론적 측면에서 회복적 사법에는 개념적 혼란, 형성기제의 부적합성, 다중의 불명확한 목표, 조치부과의 기준부재 등의 문제가 있었다. 시행과정에서의 문제는 피해자 측면에서 낮은 참여율, 참여의 강요, 죄책감 유발, 낮은 피해변상비율의 문제가 있었고 가해자 측면에서는 강압적 유죄인정, 임의적 조치부과, 국가통제망 확대, 재리의 위험의 문제가 있었다.
본 논문은 회복적 사법의 문제들이 해결가능하지 않으므로 전통적 형사사법제도와 분리된 형태의 회복적 사법프로그램이나 대책은 비합리적이라고 판단하고, 전통적 형사사법제도 내에서 회복적 사법의 이념을 실현할 수 있도록 노력할 것을 제안한다.

Restorative justice has become the most popular issue in recent discussions on criminal policy. The purpose of this study is to examine the theoretical foundations of restorative justice and problems encountered during implementing restorative justice programs. Conceptual confusions, inadequacy of generating mechanism, multiple and unclear goals, and lack of dispositional criteria are discussed as critical theoretical problems. Not a few victims have been found to suffer from restorative justice programs in terms of unintentional participation, induced guilty feeling, and low completion rates of reparation. Offenders also tend to experience difficulties in terms of coerced confession, deliberate restorative outcomes, net-widening, and double jeopardy. This study suggests that not restorative justice programs but restorative justice philosophy should be realized within traditional criminal justice system.
