한국법사회학 문헌 조사 연구 : 1945부터 2020까지 = A Research Study on the Bibliogahpy of Sociology of Law in Korea : From 1945 To 2020

If a scholar pursues a research on legal sociology of Korean society, he/she needs to review what researches have been proceeded and accumulated. In a previous article, the writer reviewed a historical development of sociology of law in Korea. The article, however, had a limitation since it focused laregly on the selected articles and books of representing the main stream of sociology of law in Korea.
The following research on bibliography of sociology of law in Korea aims to supplement the previous research by providing a complete index of it. We subdivided the research fields of sociology of law into 17 appropriate headings to examine what kind of research had proceeded from 1945 to 2020. For example, the headings include history of Korean sociology of law, theory of legal sociology, methodology of legal sociology, law and social change, sociology of legal profession and judicial reform, conflict and resolution of dispute, and etc. This research will serve as an intellectual map to find out what kind of research has been performed in the area of sociology of law in Korea. We hope that this study will contribute to an academy which would further develop and deepen future studies in that area.
The bibliographical index included in this study reflects several points that are needed to further develop sociology of law in Korea. In the concluding chapter, we proposed suggestions regarding the matter; the need to extend empirical studies, the need to integrate and develop individual researches more organically, and the need to activate interdisciplinary studies.
This study will be tentative. When more researches are proceeded and accumulated, there will be a more completed bibliographical index of Korean sociology of law. We hope that there will be an opportunity to supplement the researches omitted in this index.

국문 초록 (Abstract)

한국법사회학을 연구하고자 한다면 한국법사회학의 제반 영역에서 어떤 연구들이 진행되고 축적되어 왔는지를 일별하는 것이 1차적인 작업이 될 것이다. 선행연구에서는 해방 이후 한국법사회학의 발전사를 통시적 시각에서 조감해보았는데, 이를 준비하는 과정에서 그동안 한국 학자들이 탐구해온 연구의 결과들이 상당하다는 것을 알게 되었다. 선행연구에서는 논의의 중점이 한국법사회학의 큰 흐름을 살펴보는 데에 놓여 있었기 때문에 기존 연구들에 대한 소개는 주요 문헌들을 중심으로 이루어질 수밖에 없었다. 그 과정에서 한번쯤은 1945년 이후 한국법사회학의 문헌들을 정리해볼 필요가 있음을 깨닫게 되었다.
본 문헌 조사연구는 1945년 이후 한국 학계에서 진행된 연구 결과들의 문헌을 망라해서 수집하고 이를 유사한 주제로 분류하고 정리해보고자 시도하였다. 이를 위해 법사회학의 연구영역을 17여 개 항목 정도로 세분하여 그동안 우리 학계에서 수행된 연구들의 상세목록을 정리해보고자 하였다. 예를 들어, 한국 법사회학사, 법사회학 이론, 법사회학 방법론, 한국의 법문화 및 법의식, 법과 사회변동, 법조사회학 및 사법개혁론, 갈등과 분쟁해결 등의 항목을 설정하고 이에 해당하는 논문이나 저서들을 연도순으로 정리하였다. 이 조사연구는 향후 한국법사회학 연구가 심화･발전하기 위한 기초적 연구토대를 마련하고자 하는 것이며, 또한 그 자체 한국법사회학사에 대한 일종의 기록으로서의 의미를 갖게 될 것으로 기대해본다.
조사된 문헌목록은 한국법사회학의 발전을 위한 성찰 지점을 제시해 주는데, 본 연구는 마지막 부분에서 이를 몇 가지 항목으로 나누어 정리해 보고자 하였다. 이는 경험연구의 보완과 확장 필요성, 개별 연구들을 서로 유기적으로 결합시켜서 발전시킬 수 있는 학문적 논의 공간의 구축 필요성, 학제적 연구의 활성화 필요성 등을 포함하였다.
해방 이후 한국법사회학 연구문헌들에 대한 본 조사연구는 잠정적인 것일 수밖에 없다. 앞으로 연구물들이 더 많이 축적되면 언젠가 더 확충된 법사회학사 및 관련 자료들의 정리가 가능해질 것이다. 이 조사에서 누락된 연구들에 대해서는 언젠가 보충할 기회가 있기를 기대해 본다.
